Convincing enough. Then again, maybe it was someone else on the street who jumped the gun. Wait and see but have your defense ready, you only have one week to respond to the ticket.

Hi All,

I'm hoping someone can help me with this.

 

My colleague was stopped for supposedly talking on the phone while driving. She maintains that we was sitting at a red light with phone in hand. As soon as the light turn green, this guy was waiting at her window and immediately told her to pull over. Now, she is relatively new to Germany and her German is not that good, and she could not explain herself properly.

I wasn't there, but am inclined to believe her, so I'd like to help if possible.

The problem is in the middle of this heated discussion she had, the official (he was alone), produced a blank piece of paper, scribbled something on it and demanded she sign it, which she naively did. Now she has shown me the fine and it says Beweismittel: Ihre Angaben

 

My question is now that she has signed this document, is there any point in contesting the fine at all? If it's a fate accompli, I'll just tell her to pay up, she already knows now never to sign anything without understanding it.

The use of a cell phone while the car engine is running - that's the point. You aren't allowed to use your phone whilst waiting at e.g. a red light.

Thanks, I understand, I have handsfree myself as I can never find my handy in my handbag, and it annoys me when it rings while I'm driving. I'll pass on the bad news, lesson learned.

Where would setting up the destination in your phone navigation software then fall? I very often start the engine, then set up the destination, then pull out of the parking spot (which can also be on-street parking). It technically means I am using my phone while the engine is running, I doubt they went to the length of distinguishing between specific activities on the phone.

That's another violation: unnecessary running of car engine. If you started the engine you should immediately drive.

 

As for using the phone as navi when it's attached to the windshield then you can use it while driving. Holding your phone in your hand is forbidden.

Fred rushes in and announces loudly, 'I tell you, women drivers are a hazard to traffic. Driving to work this morning on the freeway, I looked over to my left and there was this woman in a Jaguar doing at least 70 mph with her face up next to her rear view mirror putting on her mascara.

 

I looked away for a couple seconds and then the next thing I knew was she was careering all over my lane.

 

It scared me so badly that I dropped my electric shaver into my coffee, and it spilled all over my mobile phone.'

Most parking lots have a sign that say that the standard traffic rules apply while in the lot. I don't know if that means that the police can bust you for breaking the law, or it would be the owners responsibility though.

The owners (or anyone else for that matter, including the police) can report you to the police if they believe an offence is/has been committed while on their property where the StVo applies. This also applies to private property with open public access, even where no specific sign is shown.
