Correct.  Werkstudent time does not count.  The first comment does not make clear if it was a normal part time or a werkstudent position.  And I missed it was only 4 hours a week, the limit is minimum 15 hours a week.

I worked teilzeil (20 hours per week) From January 2020 to March 2021. Then minijob (10 hours a week) From April 2021 to June 2022. And then Since July 2022 fulltime 38.5 hours a week till now.

The first part time might count as long as it is not a Werkstudent contract.  The Minijob time will not count.

Hi, I am still a bit confused  here. What do you  mean by "Werkstudent Contract"? I was working  part-time, from 10:00 - 14:00 From January 2020 to March 2021. Then minijob from April 2021 to June 2022, and finally fulltime  from July 2022 till now!

Werkstudent is an official student position, which you do as part of your studies.

Update 29.03 2023!

 

So, as we had a termin at 9 a.m, she came to office at around 10:35. She asked me to give her the signed letter, reset the company laptop and leave. I told her that I have decided not to sign it, and that she can fire me if she wants and can give me the termination letter. She got furious that I haven't signed the paper yet, and told me to reset the company laptop and leave, and that I will receive my termination letter in my mailbox. I told her to give me the termination letter and I will leave, or to give it writing that she wants me to stop working and leave the office. She got very angry and said ok I will write you an email in the next few minutes, and went to office. Now I have already reset the laptop and waiting for her email.

Make sure she writes in the Email that she told you to reset the office laptop etc. and go home and that you will receive your termination letter by post. Tell her to send you the termination letter by post and make sure to mention the 3 months termination period.

12:41 p.m. She came to me and asked why am I still here when she clearly told me in the morning to reset the company laptop and leave, and that I will get my termination letter in the mailbox in next few days. I told here I am still waiting for her email. She went back to her offuce without saying anything else.

Finally I received the email:

Leider wurde meine Freistellung von der Arbeit für heute von vor einer Stunde von euch mit dem Kommentar zurückgewiesen, ihr wollt dies unbedingt schriftlich von mir haben, da das Verlassen eures Arbeitsplatzes von mir im Nachhinein zu eurem Nachteil anders dargestellt werden könnte.

 

Ich empfinde es als Unverschämtheit, mir zu unterstellen, ich könnte so handeln.

 

Ich stelle euch hiermit für den Rest des heutigen Tages und morgen von der Anwesenheit im Büro frei.

 

Heute morgen wurden leider die Firmeneigenen Geräte etc. wie in meiner heutigen email angewiesen nicht von euch im Büro abgegeben mit dem Hinweis, dass die darauf befindlichen privaten Daten erst übertragen werden müssten. Dies könnte mehrere Wochen dauern, wie lange genau wäre nicht sicher vorauszusagen. Das ist inakzeptabel. 

 

Für die Abgabe der Geräte u.ä. in einwandfreiem Zustand setze ich eine Frist zum Freitag, den 31.03.23 um 12Uhr mittags. Die Abgabe erfolgt in unserem Büro in der "ADDRESS" an "THE PERSON'S NAME"  inklusive einer Liste der abgegebenen Gegenstände.

 

Diese Arbeitsatmosphäre mit eurem gegenseitigen Aufhetzen und Unterstellungen gegenüber mir ist inakzeptabel und sehr unproduktiv."

She is still trying to pull a fast one on you, by saying that there is no termination letter since you didn't sign the Aufhebungsvertrag.

The question in my mind is that should I reply to that email? Because if dont reply to that email then it means everything she has written is true and by not replying I accept that its true, which is not as she is trying her best to find some reasons. Is there anything in the email that she can legally use against me later?

You are still employed. Make sure you aren't being charged for vacation days that you didn't request.

She says that you didn’t return the laptop since you said you had some private stuff on laptop? Hence she set a limit for 31.03. 12 O’clock to return the h/w. 
 

btw she told you not to come to office rest of today & tomorrow. So make sure you go to office on 31st :)

Thats the thing I'm thinking about. I have nothing private on the work laptop. I only use it for work purposes. I'm wondering if she can use that against me later legally.

I guess in that case, you can answer her already that you don’t have any private stuff on the company’s laptop and never said such thing. Tell her that you are ready to return the hardware whenever she wants. And save a copy of sent Email. Also ask her whether she wants to keep 31.03. for the return or wants it early?

But you shouldn’t give any justifications about whether you were productive or not or other work related stuff. She had 6 months to decide. 
 

i‘m not sure whether she can hand over the termination letter to you in person or it must be sent via Post.

 

Maybe someone else can comment on that. There is a slight chance it doesn’t arrive until 31.03. if it must be delivered via Post ;)

Now the main question is, what should I do on Friday when return the laptop? Because I am not going to receive the termination letter by then (most probably) because she hasn't prepared anything and also one of the other employee (who is also fired) heard her talking on the phone and telling the person that she has not received anything back from her lawyer as the lawyer is currently on vacation. Now my question is how do deal with the whole situation on Friday? Do I have to go office if I dont get the termination letter by Friday as in the email its only mentioned until Friday?

the situation is clear from the legal point of view:

you received an email with unsubstantiated accusations (private stuff on company laptop, "gegenseitiges Aufhetzen") and clear instructions to
go home for today, and stay home for tomorrow. Also you were told to return company equipment in a factory reset condition on Friday.

 

You were also told there will be no termination letter any time soon, because she has to consult with her lawyer first about proper form.
The reason given here (because you didn't sign Aufhebungsvertrag) has no bearing in this context - if you had signed that, there would be no letter of termination necessary.

Make sure you answer her email - something like this:

Sehr geehrte Frau XXX,

vielen Dank für die bezahlte Freistellung am 29.3.2023 und 30.3.2023.
Ich habe und hatte auf den genannten firmeneigenen Geräten zu keiner Zeit irgendwelche privaten Daten oder Informationen. Die firmeneigenen Geräte werde ich Ihnen am Freitag, 31.3.2023, Ihrem Wunsch entsprechend in sauber zurückgesetztem Zustand übergeben.
Ihren Vorwurf des "gegenseitigen Aufhetzens" muß ich auf das Schärfste zurückweisen. Wenn ich mich mit Kollegen über wichtige Themen austausche dient dies ausschließlich der Klärung für mich schwer verständlicher Sachverhalte.
Bitte erklären Sie mir noch, welche Arbeitsmittel ich nach Abgabe der genannten firmeneigenen Geräte ab Freitag, 31.3.2023, für meine vertragsgemäße Tätigkeit einsetzen soll.

You need to show up like clockwork in the office, even though you may not have any tools (because she made you give those back). Even when/if you receive a proper Kündigung, you have to show up for work until the company tells you otherwise. In either case, they have to pay you for the full three months of the termination period - and more, if you want to sue them.
