police cannot decide on car accident

61 posts in this topic

Today a woman hit me behind when I stopped at the traffic light. She claimed that my car has been floating back and hit her car. It's so funny and I rejected it right away. Police is called and they can't decide on the case. They suggested me to call my insurance company so that they will arrange. Does that mean they assume I'm the wrong one and the insurance will claim me, or reduce my SF?

What you need to do is make a claim to the woman's insurance company!  You have her & her insurance's details?

If the police can't/ won't do anything, you'll need to open an Anzeige with the police against the other driver.

IIRC you can't claim against her insurance. Technically only she can.

Ask your insurance for help.

If it comes to he-said-she-said then your SF may well take a hit.

What's the damage like to the car?

Does your neck hurt (whiplash)?

"Floating backwards".  So traffic lights on an incline?   Presumably if police say they could not work it out.

only lightly bend of the number plate. I have no problem at all. I think I'm going to create the Anzeige against her. Should it be done directly at the police station?

I can most definitely feel your whiplash injury. Even thru' the ether.

Drifting backwards at less than walking speed would cause next to no damage, if any, upon impact.

If she rammed you from behind uphill, I guess she was not at drifting speed and any damage would be more significant than a kiss to her bumper. So what was the damage ?

At any rate, the bitch was too damn close. You remember seeing the whites of her eyes in your rear view mirror, surely.

Yes, trip to the police station.

I love it when you present evidence and the spineless will not take a stance.

that's correct. It's like she just ramp down to right behind my car from 70 km/h or so. The bitch drives from other city and seems to be in hurry.

Is there a gradient on that bit of road, so that the vehicle "could" have rolled back?

Even if there is, the title may be correct, maybe the Poelitz "can not" decide, or rather establish/prove what happened.

so, did you float backwards a little?

It's like when you start on the incline, when the traffic light turns green. Of course it went a little but not more than 0.1m. And the car behind for sure must be 3-5m in any case.
