Is it a DISCRIMINATION at work place.?

I am working at a logistic for my minijob apart from my studies. I am having a medical condition where I am not allowed to lift weight for long due to one chronic ailment yet there is one disponent  and he gives me very tedious heavy task every time. but not with others.!

 

What sort of intention is this.?

 

Can it be considered as DISCRIMINATION at work place.!?

Even if, it would be hard to prove. Have you provided a medical certificate exempting you from hard pysical labour?

The correct term is mobbing. It might be connected to your race/religion/citizenship or political view, then it will also be discrimination. Both are illegal, though. 

 

What you can do: record date and time when it happens, and the name of the colleague. 

 

Then file a written complaint to his superior. 

 

If that brings nothing, keep recording all the events (do not record with the camera, German authorities do not like hidden recordings, it is also illegal!), contact a lawyer for the further advice.

Irritated linguist here. "Mobbing", as should be implied by its core "mob", is by definition done by a group and normally involves violence. The correct word is, in fact, "harassment". In all other respects, yourkeau's comments are correct.

Skinnypuppy, this would be correct in English, but yourkeau was referring to the German use of the word. In German bullying in the workplace is labelled as "mobbing"

Do you have a Betriebsrat/workers council at your workplace? If so I would make an appointment, inform them of what is happening and get their professional advice.

Here's a novel idea... have you considered talking with the disponent?  Perhaps this person is unaware of your physical limitations.  Before you go through official channels, why not give this individual the opportunity to rectify the matter.  If it continues or you are ignored by the disponent, that will carry weight with your company's leadership.

I am an Indian national and the disponent is from Syria.

He itself a disponent on that particular shift. When ever he sees me he send me to Heavy weight operation.

I left the work place 3 weeks back because of this issue and I dont want to.be there.

 

I do notified the company management through Google review. But in short ."As some their employees being BIASED and PREJUDICED"

Yes, I was referring to the German word but I appreciate the correction anyway!

 

Today I was googling if couple is singular or plural. It seems it could be both. Crazy!

German auslanderbhoerde s have very low google rating , still they are flooded with work 😀

Btw, be careful with public tarnishing of establishments. They can file case against you and you will have to face consequences if you can't prove your aligations in court.

@bloomfirst of all, let me tell you I feel sorry for what you were going through.

 

Since you already left the job, there is really not much you can do about it after the fact. Posting Google reviews may help you feel better in the moment, it may help other people in the future, but it doesn't help to fix anything at the company.

 

So, my advice for you in any future jobs would be to communicate well, clearly, up front, before you even take on the job - and then continue to communicate well and in an open, constructive and auditable way throughout your stay.

 

Make sure every detail is documented in writing - word of mouth can be easily misunderstood, misinterpreted, and overlooked.

 

Especially in this particular job situation, where you were working at a logistics operation - and had weight lifting restrictions. Bring the appropriate doctor's note when you apply for the job, make sure it is written into your work contract, and remind your supervisor of it whenever they tell you to move objects over the weight limit.

In the real world, where competition is stiff, do you think he would even get the job if he goes in highlighting his limitations ?

if that was me - trying to find a Minijob to supplement my student income - I would not jeopardize my already compromised health by applying for a job that I personally knew I couldn't really tackle.

Members. i was not recruited there directly instead through Student job agency.

 

and

 

The moment he gave me the tedious task I communicated my student job agency through distress email. "That I am in pain while other students are chilling with the Computer based task"

and got reply and some more email conversations on that.

 

Guess that would be sufficient for any record.
