Unmarried - naming of child / birth certificate and custody

4 posts in this topic

hi all

Wonder if you can help?

I am currently 31 weeks pregnant and live in Nürnberg.

My partner and i have been together for a very long time and are unmarried and British.

We have tried to book an appointment for paternity declaration and custody set up but no appointments until 2 months after baby due (thanks corona 🙄)

We want the baby to have his surname and we want him to be named on the birth certificate - I have been told this is not possible

I have also been told that if I die during child birth, the baby will go into care and he has no rights as we are unmarried.

I have also been told he cant register the birth or have any say with medical needs

I'm really getting stressed out about this and would love someone's guidance who knows the facts.

Also, please don't say just get married. I'm not married through choice.

Thanks so much for any help

Good wishes for your news.

Have you tried searching on TT- I typed in paternity, birth registration, non married, and lots of posts/threads came up with info and advice.

I am no expert , but it seems it is possible, but complicated.

Note- your matrimonial status is entirely up to you, but you will have comments on  marriage makes it so much simpler!.

https://www.nuernberg.de/imperia/md/standesamt/dokumente/stn/merkblatt_geburten_stand_2009_internet.pdf explains what you need to register the birth and about the father.

Bei bisher unverheirateten Müttern - Geburtsurkunde - Document you need to register the birth as an unmarried mother - Doctor's certification of the birth.

https://www.gov.uk/register-a-birth will be of use to you for the UK side of the paperwork.

You must register your child’s birth according to the regulations in the country where the child was born. They’ll give you a local birth certificate. This local birth certificate should be accepted in the UK, for example when you apply for a passport

Go to a German notary. It'll cost more than the city/municipality, but you should be able to get it done before the birth.
