Subletting

3 posts in this topic

Hi!

I wonder if someone can clarify for me.

I am permitted to sublet my apartment.  I need to know if this mean i can then register myself at another property and then keep the initial flat, but with someone elses name on the door.

Or would i need to remain on my original property.  I ask as my partner is pregnant and we will get an apartment together, i however do not want to loose my flat.

Thanks!

Permission to sublet your apartment is given by the landlord upon your request - if you have a valid reason, and there is an end to the arrangement.

You don't need to be in the apartment, but you have to have a planned return date.

For example: you will be working, studying, travelling abroad - and want to return to your apartment after that.

Your personal belongings remain in the apartment, you may even sleep there from time to time, everything points to a "temporary" absence.

What you are planning here looks "open-ended" to me.

Why not? You are going to need a good reason in order to obtain written permission from your landlord to sublet your apartment under these circumstances. Subletting without permission is considered grounds for a landlord to terminate the lease.

I would suggest you contact your local Mieterverein for further advice.
