Non-compete compensation during unemployment benefits (Karenzentschädigung und Arbeitslosengeld)

Hi there,

I have a question regarding the following situation: if as per my working contract I am entitled to non-compete compensation, and if I was terminated from work due to operational reasons, are there any limitations to receiving both my non-compete compensation (Karenzentschädigung) together with my unemployment benefits (Arbeitslosengeld)?

Happy to elaborate if needed. Any answers would be of help!

Yes, there are limitations. You cannot receive both - for two reasons:

 

1) If you're still receiving compensation from the company, you're not entitled to unemployment benefits (proceeds from a severance package are also offset against your unemployment benefits, at least partially).

2) To receive unemployment benefits, you must be available to the labor market without restriction. Your non-complete clause violates this requirement.

 

Please note, however, that I'm not a lawyer. This is the situation as I understand it.

I think that actually the two can be received together, as per this document here. As 158.1.3 states:

158.1.3 Leistungen die nicht berücksichtigt werden
Keine EE sind insbesondere
- Abfindungen gem. § 1a KSchG nach Arbeitgeberkündigung
- Erfindervergütungen,
- anteilige einmalige Leistungen für zurückliegende Zeiten,
- Treueprämien,
- finanzielle Anreize für Arbeitnehmer zur vorzeitigen Beendigung der Beschäftigung in der Transfergesellschaft zugunsten einer Arbeitsaufnahme
oder einer Selbständigkeit,
- ausgeschüttete Gewinnanteile,
- Jubiläumsgelder,
- Karenzentschädigungen wegen eines vertraglichen Wettbewerbsverbots,
- ausgezahltes Wertguthaben
