What constitutional change are you talking about? Federal Constitution does not regulate naturalization at all, Bavarian Consitution states that one can obtain citizenship via naturalization, that is it (and it is valid as soon as it does not contradict the federal law). 

 

The applicable law can be amended by a simple majority. Yet I agree with you one should not count on promises and might-be decisions.

Hello, I just called to ask about the Antrag for Citizenship, they told me that I need to bring a Test Result for minimum language level B1.

The question is if this is mandatory and how to obtain it.

I think my German is over this level but I don't know what these tests consist off.

If both me and my wife want to apply, do we have to fill one or two Antrag documents? I see the data for the family is already included.

Is there any possibility to obtain a proof from the employer that I speak German and to skip the B1 test?

I have an A2 already.

This is entirely at the discretion of the person processing your application. The requirement is that you satisfy them that you have an appropriate level of German and the test certificate is proof of that in a form they are required to accept. They are allowed to accept other forms of proof but not required.

So for example when I applied, the case worker read through my application, asked me if I had filled it in myself, and commented that if I had done that and passed the citizenship exam, he was willing to accept my language skills as good enough. He did call in a co-worker who also had a brief conversation with me just to check, and then he wrote down on the form that I had proved my language skills by interview.

 

I suggest you start the process before you sit the exam, and discuss with your case worker what documentation they need.

Thanks a lot, I guess this depends a lot on the person that you meet when you make the Antrag?

I called around 1 week ago to the Amt, and I asked this and the person there answered that he doesn't recomment to make the Antrag without

already having a B1 Test result at hand ...

Just for my curiosity, when did you apply, was it recently or a long time ago?

I already made a Termin for a B1 Test at the end of the month and now I am preparing for it, so I guess it is too late to walk to the Amt?

I did mine in 2018, so recently but not very recently, it was a brexit related thing and I think my guy was trying to make it easy for me. Also I was in Bremen which may well make a difference. I only really posted to say that they do have some flexibility.

Ok, I did the B1 Exam, waiting for the results now but I guess I can go and make the application in the meantime?

I want to make an appointment for the Einbuergerung test but I find it very difficult to find where it is online, any idea if there is some central

website where I can find all the appointments in NRW?

Don't you need the B2 for this 6 years? or do you have the other "besondere Integrationsleistungen"?

B1 German Level  is must for applying after 8 years of lawful residence 

B2 skill is minimum mandatroy one to apply after 6 years of lawful residence

Ok, very dissapointed after trying to apply.

Got an appointment at 8.00 AM on Monday at the local Rathaus.

Everything seemed to go ok until I told her that I did the exam last week.

She said she can't take any application without having the complete papers.

Funny thing I have multiple colleagues who told me they applied without having all the papers and then they brought them

when they had the results from the exams or other documents ready, but the application was running in parallel during this time.

Should we try to apply at the regional center, maybe the local employees are too pissed off to actually work?

This is my impression after the meeting, the employee looked really bored and not to eager to work.

In my opinion, she/he was right, B1 Language certificate is mandatory one, having this not submitted during filing application, means candidate is not ready. I do not think, without Einbürgerung Test and B1 Certificate, they take some ones application. 

I guess, you prepare well next time, not to waste a time of officers, who want to take their duty seriously.

Please ask for a checklist, key documents to be submitted. 

Take an example, you are filing after 6 years stay with C1 or B2 certificate, you say that you gave a exam only last week and results not there yet, it means you are not eligible to file an application.

It all depends on with whom you’re dealing behind the desk. If you can demonstrate clear B1 level during the interview, you might not have to show any certificate. I know some people in Munich where this was the case. Bonus points for wearing a Lederhosen or Dirndl 👻.

I did apply without B1, and I still don't have it, however I was applying after over 10 years, in Bremen as a man married to a German and with Brexit as a background. I'm sure they were especially lenient with me.

 

What I have actually said in every one of my posts on the subject is that the requirement is not B1 German.

 

The requirement is that you have " have sufficient command of the German language " (Well actually it says über ausreichende Kenntnisse der deutschen Sprache verfügt  but I linked to the English translation).

Other nationality law then states that this corresponds to B1 on the EU standard classification.

That often means that a caseworker will only accept B1, but they are allowed to assess your language skills in some other way if they want to.

 

Your first appointment should have been to agree a checklist of documents and requirements, then once you have all the items on the checklist you can start the approval. 

 

Sorry if you misunderstood something I wrote, and for the sake of anyone else reading this in future.

YOUR CASEWORKER IS THE ONE WHO DECIDES WHAT YOU NEED BASED ON THE LAW AND THE INTERNAL GUIDANCE AT THEIR OFFICE,.

For my application after 6 years I needed B2 (got C1 in the end).

 

Because of Corona delays they accepted my paperwork before I had done the exam and said they would pre-check everything, so that if I passed the exam all would be fine. This was because of the Brexit deadline.

 

fortunately I passed the exam and got my citizenship 3 weeks before the end of the transition period.

 

i had had a couple of long phone calls with them so they knew my German was pretty decent, this was just about getting the official paperwork to prove it. I had also previously supplied a letter from a local organisation where I did lots of,volunteering over five years, so my proof of integration.

The thing is, the rules are interpreted by your Bundesland and/or your caseworker, I think the law is quite flexible.

 

 Did I mention that I got 100% right in the Leben in Deutschland test, without any special preparation?😉
