Question about family Niederlassungserlaubnis

Hi,

 

I'm a non-EU citizen, living since 2012 in Germany with a work visa (not blue card).

My son (German citizen) was born last year and I'm trying to figure out if I can apply for a Niederlassungserlaubnis.

 

I'm not married to my girlfriend, and we lived (officially - same rent contract) together for about 1 year.

 

Reading the Niederlassungserlaubnis page it says that I need at least 3 years of living together with Aufenthaltserlaubnis. 

I'm not sure how this apply to me. I'm here for more than 3 years with a Aufenthaltserlaubnis, but my son is not 3 years old yet.

 

Anyone knows if I can apply for one, or should I wait till he's 3 and then apply?

Sorry, but this is completely wrong, as is the visa "information" you've provided on most of the other threads you posted on today.

 

As the father of a German child, he is entitled to stay until the child turns 18, regardless of his marital status with the mother. As long as he fulfills the other criteria during that time, there is no reason why he shouldn't be able to get an NE at some point - if it isn't granted from the start.

Sorry I was not aware of the law. I was told its not possible.. Nice that you updated and this person got the right information. Thanks again.:)
