  1. There is an organisation called VDK, they can help with disputes with the Krankenkasse or Renteversicherung. You have to be a member for them to help you.


    They have offices all over Germany.

    A temporary contract is a contract and has a notice period.


    If your wife has worked for up to 6 months at her present company she will be given a simple document which states something  like Mrs x worked from .. until .. as a ..at our company.


    German references contain a lot of information, date of birth, length of employment, position, duties and reason for the contract being terminated. As everything of importance is mentioned in the reference there is no need for a future employer to contact a past employer. There are no background checks between past and future employers in Germany and it is illegal (Datenschutz) for a future employer to contact a past employer and ask for information but this may be difficult to prove.


    If the period of employment was longer than 6 months your wife will be given a reference which will state why the employment ended, lack of work, in mutal agreement etc. If it states, the contract was teminated on….and no reason is given, this makes a very negative impression on a future employer.  

    Employers have a legal obligation to give a reference and this must be shown when applying for all future jobs.   Your wife could ask to end the contract in mutual agreement which means she agrees to her contract being terminated.  On the downside, this will mean that she will not receive any unemployment benefit for the first few months and has to contact her health insurance company about her contributions during this period of time. The Agentur für Arbeit can give her more information. Your wife will also have to have a good reason to explain at future interviews why she agreed to her contract being terminated if she didn't have another job to go to.





  3. The Bundesgerichtshof decided in April that banks who have charged their customers for having an account must refund the fees. This could be backdated to January 2018.  


    Apparently when banks sent their customers notice of a change, usually an increase in bank fees, they said „if you don’t complain you agree to the new bank fees.“ The Bundesgerichtshof stated that customers should have actively had the possibility to agree to the said changes, like signing a document etc.


    One bank said that people who want a refund will then have to pay 7,50 € a month as of October in bank fees. People who do not apply for a refund will pay 5,00 € a month for having an account. This amount will not be increased until Autumn 2024. Some banks have informed  their customers that their account will be closed if they apply to have the money refunded. The Verbruacherzentrale in Baden-Württemberg is considering taking legal action against the banks.


    Has anyone here actually had a refund from their bank?



  4. cb6dba is correct, you will have to pay your own health insurance. Keep in mind that it is compulsory to be health insured in Germany. You will be classed as a freiwilige member which means you will have a lot more to pay each month. You may also have to pay into the state pension system too  so why not let things continue as they are?


    When you receive state benefits, there are certain rules that you must adhere to, like showing you are applying for jobs, giving paperwork in on time and attending courses from the AA.  If you think this is a lot of hassle you will have lots more with different organisations like health insurance and state pension wanting information from you then you do now.


    You said your German is not good but you live in Germany, maybe you could apply for a German course through the Arbeits Agentur. If you don't understand what they are saying, ask if someone can speak to you in English.


    If you decide to cancel your state benefit, you must do this in writing and I would suggest you make an appointment with the Arbeits Agentur, perhaps they can print out a form for you to fill in stating that you no longer require state benefits. 


  5. You must register at the Agentur für Arbeit within 3 days of receiving your notice. Failure to do so could lead to you not recieving unemployment benefit from the first day. Make a copy of your sick note to take with you.


    Check your contract regarding the notice period and make sure you get a good reference. Do you have a Betriebsrat?


    As Luke said above, there is a shortage of lorry  drivers so hopefully you will not be unemployed for long. Hope things turn out positive for you.







  6. It is a great pity that we did not win but it was a good and fair match. Gareth Southgate has publicly declared that he made all the decisions be they good or bad.


    The players can hold their heads up high, they got further than France, Germany, Netherlands and Portugal to name but a few. To be second best in Europe is also something to be proud of.   


  7. The G37 eye-check is carried out by the company Doctor. There are rules concerning the distance between the user and pc which he/she may also check. 


    If it is not necessarily work connected ,people here usually go to an Augenarzt for the check-up and then to the opticians. The opticians usually do another check and then you can choose your glasses.

    So sorry to hear that. We always take older cats from the Katzenhilfe and when the end draws nigh it can be very painful and expensive but it is worth every penny.

    Take care of yourself and relax at home. The world needs more people like you who are prepared to give a loving home to a sick animal.




  9. When you leave your present employment, you will be given an Urlaubsbescheingung which states how many days holiday you have taken with your present employer. You must give the next employer the Urlaubsbescheingung so  he/she can work out how many days holiday you may take according to your yearly legal entitlement.

    It is a similar situation to Elterngeld, in former some time people changed the tax class as soon as they knew they were pregnant in order to maximize the Elterngeld, in order to stop this they introduced a rule that the nett is calculated based on the average from long before they were pregnant.


    It is not just Kurzarbeit, it applies to other payments like sick pay from the Krankenkasse or unemployment benefit. Payments are usually based on the netto sum of the last six months. As it is usually women who have tax class 5, they should really consider the implications  if they should become ill or unemployed.  


  11. I believe you are looking at situations 1 and 2 from the wrong view point.


    Situation 1: The colleague who you temporarily replaced has now returned. Your other colleague will be able to continue working for the company, she is not pregnant.


    Situation 2:I assume the transfer list is for colleagues with a permament contract. Why would you be put on a transfer list if your contract finishes in September anyway? 


    You could spend a lot of money on a laywer to fight your case or accept that your contract will end as agreed and make sure you get a really good reference.

    I am so sorry to hear that   Leon.  It is terrible when a cat dies, the feeding bowl and toys remind you of happy times together that will never be repeated. Even though cats don‘t make a lot of noise you are always aware of their presence

    Our last cat had kidney troubLe and the vet said he should only be given special cat food. We donated all the normal cat food to the Tierheim and bought the special  food but the cat refused to eat it.

  15. That is a good idea fom Jeba. Ask for another sick note and then apply for a Kur. This means you will have about 6 weeks to rethink your strategy and be paid for it. Don’t worry about some of your colleagues having to cover for you, that is one of the tasks a Betriebsleiter is paid to do.   


    During this time you can search the market for a new job or decide to stay where you are.


    You could also contact the Arbeitsagentur to ask if you will qualify for unemployment benefit from day one because of your situation. A friend of mine was in a similar situation and didn‘t have to live off her savings at all. I must add that other people left her company more or less at the same time and the company name kept cropping up in the reason for leaving at the Arbeits Agentur.


    Please think very carefully before leaving without a new job in sight. You said you have no German qualifications and you only want to work part-time and we have Corona too.


    As Engelchen also pointed out, start thinking about the reference you would like just in case. What are your main responsibilities, have you worked on any projects. Are your customers satisfied with you? The date and reason for leaving is very important. After five years of working at your company make sure the leaving date is at the end of a quarter not in the middle of a month .


    Take a deep breath, appply for a kur and pamper yourself a little.:D

    You think complaining about these things is a one road to hell, well how would you describe the situaiton you have been living in for five years?


    Are you saying that you have put up with situation for five years and have done nothing about it because 1. your neighbours said there is nothing that you can do and 2. because you don't want to fight your neighbour. Sorry to inform you but that is the reason why it has gone on for so long. You will have to make a decision, to grin and bear it or do something about it.

    They deal with lots of things such as noise levels, people working on Sundays and bank holidays and after 10.00 p.m. for instance.


    BTW: People like your neighbour only do these things because people like you and your neighbours let them.
