Tax Fraud - what can I do

if I'm being accused of it

It would appear that my (ex-)tax adviser undercalculated my income in the year 2000 to the tune of 12,000DM. Now the tax office have got wind of it and are saying it's legally my fault. There's going to be a fine and interest charged.

Assuming the tax office are correct and my (ex-)tax adviser has indeed made this mistake, can anyone tell me what the chances are of me privately sueing him and getting him to pay the fine and the interest as well as getting my fee back?

I am grateful for any advice.

A nasty situation - I nearly ended up in a similar situation some while back but it was headed off just-in-time by a visit to another advisor who dealt with the Finanzamt for me. She speaks English and is reliable, trustworthy and helpful. You can contact her here: Ursula Cottam 08141 358 558. I'd suggest to phone her up, explain your situation and ask if she can help. There have been some other TT posts about tax advisors, maybe a search will bring them up.

There are some real cowboys, many nothing short of criminal, who are operating, preying, on foreigners. As far as I understand it they do the forms, but you sign them, the buck stops with you.

I guess you have seen this the hard way but it's essential to get good advice, only go for someone who is trusted.

If your tax advisor really did make the mistake, and it wasn't a result of (lack of) information you gave him then he's ultimately responsible. He should have liability insurance to cover just this type of thing. If not, then you can sue him. I hope he's still in business...

Some years ago I discovered a mistake made by may tax advisor which had resulted in an underpayment of around DM20,000 on my behalf. I told him about my concerns, and he agreed. However we were close to the (I think) 7-year limit on how far the Finanzamt can go back into ones affairs so we agreed to sit it out and see if anyone spotted. He assured me (in writing) that if the mistake was discovered, and it was found to be his fault (as he was admitting) then his liabillity insurance wold pick up the tab, including the missing tax...

No-one ever found out, so no-one suffered...
