I am indian and living in germany for last three years legally paying tax etc. Can i apply for German passport for my SON who was born in germany? both parents are indian.

The problem is that neither parent has been resident in Germany for at least eight years. If one of you had been, he would have been born a German citizen, but AFAIK, India doesn't usually permit dual citizenship.
