Hello All,

I am here in germany and working for the past 2 years and 10 month. I am about to go for my work permit extension. In my work permit it stated that i can work only for the present company. I want to get a work permit which is not bound to the company. Can any one give some info on whether i am eligible for this and how to get it.

Take a printout of the two paragraphs and take it with you when you go for the extension.

An unlimited work/living permit that is not tied to a company will take a min. of 5-6 years to obtain. If you have already been here for 2 years, then your
next permit is also going to be for 2 years (Perhaps 5). Until that time your stuck with you current employer, or if you still want to change jobs then you
must go thru the entire job review process again.

Hello Shumi,

Today i went to get my extension with the two paragraphs you sent. I was told that they will submit an application to the Arbeitsamt for getting an Beschaftigung erlaubt and i will receive a new termin by post in 8 weeks time. Then to my surprise they gave me a one year visa which was bound to the company. When i asked, they said this will be changed once i get the new termin. I am not sure whether this works or not. Do you have any idea regarding this.

Yes, they take a few weeks. Now you just have to wait for the letter. Visa is valid for one year and there will be no change, but they will cancel the company name and give BE on the termin date.

Just for future information to people that are interested:
The above post is complete bullshit, as you will find out if you peruse the two links posted above on this thread.
Three years is the more likely scenario to obtain an unlimited permit, although I have also seen documentation specifying two - currently checking this with the Arbeitsamt in Munich for a ruling.

Its upto the people to take this post. I took the printout from the link in the
post and then showed it to the auslander amt. Now i have got the work permit updated.
Work permit is no more bound to the company. This is the case in duesseldorf.
Hard luck if you dont get it.

Well perhaps things have changed since I went thru the process a few years back. That doesn't mean that I am wrong, only that that was the process
I went thru. Don't believe me, I have the paper work to back it up.

The above 2 links are not even a valid German Govt. website, the domain is owned by a private person, thus even that info. can be wrong.
The only way your going to get the real current info, is via an official govt. website, or by contacting a local office as every bodies situation
is different.

My situation looks like this :

I complete 2 years with my current employer end of July and my VISA(company bound) lasts until Aug 2010. So, I was wondering If I could get rid of my employers name end of next month. Can I just rock up there with a prinout of the above clause and request for this inspite of not needing an extension? I guess the only thing that matters is having paid one´s health insurance and tax over the 2 years.

Your feedback would be appreciated.

So, I printed the 2 articles above and went to the KVR and got an unbound work permit. The guy just took a quick glance at it and knew exactly what it was.

Just to clariy (as I was confused until after I went there and figured it all out). DK is correct in the 5 year statement, but that is for the residence permit, not the work permit. As stated in the link, if you have lived here for 3 years and have been paying into the insurance system for 2, you can get an unbound work permit.

Just a quick note though. When going to get this, you also need your last 3 pay statements and your rent contract!

Babs, is selbständigtätigkeit still forbidden in your new permit? Or as an american it never was?

Well, that's the thing. I didnt specify as I really didn't care (or even think about it to be honest) about freelancing (been there, done that) and so that part they left as it was written in my last 3 permits (freelance not allowed except XXXXXX (what I had applied for))

The new permit has that I can work anywhere as an employee - no limits, but I can not work freelance except XXXX. So, I dont know if this is because it was that way before or if it is that way for everyone???

And thanks for the congrats, you have absolutely no idea how estatic I was this am - knowing that I can walk out of the door of my horrible job at anytime and just go across the street to starbucks or a cafe at any time biggrin.gif I do have to say that this thread is indeed the best ever TT thread for me at the moment!!! There is just no way I could have held on 1 more year (to the umbefisted) in my current job.

Now, to find a proper real job again unsure.gif

It does make life easier. Like I mentioned in my post above, I´d like to know If you went to the KVR specifically to get this done or as part of your extension? Is the rent contract mandatory? what If one were legally working in another EU country as part of a secondment but yet paying into the German system.

I have paid into the system for 2 years now and would be happy to get rid of my employer.

Both, went as current resident/work permits were expiring - but armed with the info from this thread to get the work permit part unbound to my company. The unbound work permit is only good for 2 years as is my new residence permit. But he said I just need to come in in 1 year (my 5 yr point) and then I get the unlimited work/residence permit together (and hopefully my last trip ever to the KVR!)

Yes, for this work permit it was. I had to run home and get it as didn't have it with me. For the permit that is tied to your company it is not.

I believe it specifically states "German Insurance Scheme" But I really don't know???

would be happy to get rid of my employer.
Is always worth a try, worst they can do is say no!

So, to add my final conclusions to this process, I have now also received the unbound work permit, after being here for 2.5 years.
I first contacted the KVR via email, asking if this was possible, giving as reference the sections from the website above.
They then sent my request on to the Agentur fuer Arbeit, who asked for me to provide evidence of salary and health insurance for the last two years, nothing more.
Confirmation then went back to the KVR, and I received the updated permit.

One question, although possibly a stupid one : If I am now without work, say for one or two months whilst changing jobs, does anyone actually care? Or do I have to let the relevant authorities know?

How much time does it takes for KVR to process your application?

I had been in Germany working since last 2 year & 2 months .
My Residence Permit is expiring in another 6 weeks? I am getting interview calls for new jobs.
But since my work Permit is company bound .. Employers are not positive abt it... Hence I am not able to make it..

I see some nice replies here..Pls comment .. If I can hope to make it through ..
