Guys, that position was based on the responses from, for example SaraByrd "If you don't stop at a bike there is no guarantee you will not drive drunk." and particularly wrt the judge who punished the pedestrian taxi driver because, in his opinion, the guy would not have been sober to drive the next day. That sounds like "preventive sentencing" to me.

That's not how it went down. The taxi driver came into contact with the police twice (piss drunk) and was then ordered to take the MPU because the authorities suspected he had a serious drinking problem. He lost his license because he refused.

Thanks for some of the useful comments following my earlier question. (It was a little tricky to find the thread, as the title has changed)

I just thought I would give an update to say what else has happened.

Following the summons to the police station, he went along as requested. Here he had to confirm all his details (name, address etc) and give his driving licence number. This was interesting because the german police computer couldnt accept the UK driver number - so actually they only have a part of the number.
The officer said that the file would now go back to the arresting officer and then be passed on to the Stadtsanwalt, though wasnt sure how long it would take before we heard anything further.
He thought as it was a first offence the penalty would be a fine, but had no idea how much it would be.

I shall add more info when we know more, it might help someone else in future.

don't get it. rode all over london back in england pissed as a skunk. never had a prob with plod. and everyone knows that drunk cycling is more fun than when sober.

we've regularily been playin fahrrad krieg on the way home. involves riding bike at speed into your opponent with the aim of disabling the bike (or person). great fun pissed or not. just hurts less when you fall off drunk.

last friday the police found my friend and i sprawled across the pavement after i'd rammed his bike and we were both on floor laughing hysterically. we saw the car, got ourselves up and i trotted over to the car. plod asked what was going on and in between my hysterics i tried to tell him that my mates bike had a flat tyre and a buckled wheel (didn't tell him why). he started to laugh. told us to push the bikes home. seems reading all the original post we got off lightly.

do not understand the logic of taking away the drivers license but allowing you to continue cycling. cars are vastly different from bikes, bout a ton or more. the damaged that can be caused on a bke will (mostly) only affect the person riding it, i.e. their problem. this isn't so with a car. i know that if i'm needing to drive i will not drink. not worth having that against you shuld you be so unfortunate as to have an accident.

two of my past victims...

guess we'll have to play away from the road in future, can't afford any black marks aganst me let alone a fine!!!

because they simply can't, if it was possible to ban people from cycling they probably would do it.
