Since the introduction of truck tolls on German motorways, eight Federal States have also used the toll cameras to collect vehicle data for comparison with police searches. Not so quick decided three motorists from Hesse and Schleswig-Holstein who took their case to the Constitutional Court in Karlsruhe, which today ruled in their favour stating that the data collection was against the German Grundgesetz.

Why is this the case? Well, as the motorists felt that as profiles of vehicle movements could be created without any prior suspicion, this could be a restriction on personal freedoms. Read the official English translation of the Basic Law here (PDF).
The eight affected Federal States are: Hessen, Schleswig-Holstein, Bavaria, Bremen, Brandenburg, Hamburg, Mecklenburg-Vorpommern and Rheinland-Pfalz
Baden-Wüttemberg was due to introduce such data collection this summer.
