I am living in Germany since Jun 2004, and also get marrid in Nov 2005 with a Germany nationalitate, also I have got an job opportuninty with help of my German Partner, and I have worked for two year with a German firm, at the moment I have problems with my German partner ,and after 2 year and 4 months I want to get divorce with him, also I have resign my job and at the moment I have no job, I dont know what will happen with me after divorce, Can somebody help me and guide me ? when I will take divorce, than what will be my visa status, May I allow to further live in Germany, or my visa will be cancell.
(My Visa is not unbefristet (not unlimited) , It is just for three yaer, after 8 months it will be expire and I have to apply for new visa.)

What kinda of visa/living/work permit do you have in your passport? Does it s unbefristet? If it does then its an unlimited permit
and you should be able to stay in germany and work wherever you want for as long as you want.

I come from non EU nation and married to a German citizen living here for past 3years and 4months.
I want to have kids and form a family whereas my wife only wants to have fun party travel and don't want any kids.Our way of life is completely different but still we love each other and our relationship is more like good friends.
I am currently holding Aufenhalt title till end of next year and if i apply for divorce then will i loose my Aufenhalt and forced to return to my home country?My wife suggested me that i can apply for NE as i lived here for 3years married to her and only after getting the NE we can apply for divorce.In that case will i get in trouble with my NE status when i go for divorce.
Need your expert advice.

You will not get kicked out of the country immediately, you can stay if you prove you can support yourself, etc. But if I were you I would follow your wife's advice and apply for the divorce after getting the NE. And no, you will not lose it.
PS. I am not an expert.

Yes i do have a decent job and support myself.I also think of applying for divorce after getting NE but only don't know if there is any duration to which we should maintain our relationship so the NE does not get void.

Hi multh,
If you live with your German wife for past 3 years! you can immediately change your visa staus to NE. No need to wait for another 1 year. Check your local authorities.
