Hi

we are looking to find a good lawyer in the Frankfurt who specialises in Family Law and in particular contact. My husband is trying to get good access to his son, and the lawyer we have been using has done us no favours.

Also has anyone been through the court process in Germany with access/custody etc and in particular where the courts appointed a Verfahrenspfleger (Guardian for the child). we have just been stung for 980 euros for the child guardian and also the courts proving an English translator.

We are now based in England but the child and mother live in Frankfurt. In England we would not be charged for the childs Guardian and it was shock to receive this bill.

Many thanks for all advice.

I have some sort of "gut feeling" that this might not be the last bill coming your way.

Unless they let the court choose the Verfahrenspfleger instead of appointing a lawyer themselves ... in which case the bill would be carried by the German taxpayer:

Wikipedia: Vergütung

QUOTE
Der Verfahrenspfleger wird nach § 67a FGG wie ein Vormund vergütet, mit einem Stundensatz von zwischen 19,50 und 33,50 Euro (je nach Qualifikation). Die Vergütung erfolgt stets aus der Staatskasse

The courts appointed her without any say from parents, and all visits were under court direction. At no time we were told of any costs... so should state pay?

Yes ... according to Wikipedia

You better discuss the details of the matter with the Rechtspfleger in charge or the Gerichtskasse though imho ...

That's my view as well. In England we wouldn't pay for this, it would be paid by the state.

Does anyone know of anyone who has had experience of this and did they pay? The bill came through at 980 euros and supposedly the mother is supposed to pay 980 euros also... which would make the 2 visits to the court and two house visits huge money... 1800 euros!
