hi i'm italian born and raised here. my fiancé is from canada and been here in germany for 3 months now. we got all the papers to get married. the wedding date is dec 20 but unfortunately we can't get married that day due to some family problems. can anyone tell us if there is a possibility of extend his temporary staying permit. we tried to get him a job but that seems almost impossible. he works online as an english teacher but we don't think the german government will recognize his online-job and therefore give hima work permit. can he get a student visa if he signs up for a german course? we are really desperate and hope for your answers. claudia

If he is Canadian (and isn't already here on it) he can get a holiday working visa, which is valid for one year. He can also get a visa for language study.

but he'll only get the holiday working vista if he has a work contract with a german company, right? his online job (with a korean-canadian company) won't help, right? where do we have to go to get those papers? to the ausländerbehörde or the arbeitsamt?

The working holiday visa does not require a pre-existing job offer. Its purpose is to allow its holder to fund travels within Europe with occasional work. It is for people age 30 and under from certain countries (Canada is one of them). As you might guess, some (maybe even most) people use it as a way to get into the EU rather than to find a temporary job to make a few euros to fund a backpacking tour of Europe. You would get it from the same office that issues any other visa to foreigners, i.e., not the Arbeitsamt.
The fact that he already has a job might in fact be a problem for using the holiday work visa, so you might be better off having him sign up for an intensive German course that last long enough to get you to the wedding day and allows you to apply for his Arbeitserlaubnis. If he does apply for the holiday work visa, don't mention his online job unless someone directly asks you if he is currently employed (not recommended to lie to immigration authorities).

Go to your Einwhohnermeldeamt/Kreisverwaltungsreferat/wherever the hell it is in your town that you go to for an Aufenthaltsgenehmigung or -erlaubnis. Since you're officially engaged you should have no problem getting him a 30-day extension (and possibly more than one). If he can show regular income (bring copies of his tax filings) there should be no problem with the recognition of his job.

thank you so much. as my fiancé is 36 the holiday work visa will not work. we have to go for the language course then. i guess the ones offered at the volkshochschule, right? we'll go to the ausländerbehörde tomorrow and ask them for the study visa. thank you so much again

the thing is that he already got an extension. he had to leave germany on nov 28 but as the standesamt took so long to fix a wedding date for us he got an extension so that we could get married on dec 20. but now we have to post-phone the wedding. hope they'll give him a second extension. if not we try for the study visa. thank you so much again

If you can show them proof of your wedding date they will give you an extension. I got one today, all we showed was the receipt that we paid the fees that had the wedding date and time on it. I don't think they approve it for an indefinite period. You have to get a new date. They seem very lenient if you are planning to get married and have proof. It doesn't hurt to try. If you cant get a date here, then go to Copenhagen and pay 67 euro, they have dates open in January.

Thank you once again for your support. Here is what happened: We went to the Auslandsamt this morning and first we had to face a pretty rude girl who said that she couldn't give us any kind of extension if we'd miss our wedding date. we begged her and told her that my fiancé was willing to sign up for a german course and we also told her that he actually is working for a canadian-korean company online. she stayed tough and didn't want to give us to extension. she gave our case to her workpartner. after 15min of waiting he called us in and surprized us with a 1 YEAR EXTENSION only because my fiancé is teaching online. this taught us that you never have to give up. now we can actually take our time with planning the weding and make friends and family come over from canada. bless you all
