I rented a house through Home Company in Paderborn.Firstly they asked me to deposit €500 before even viewing any apartment to make sure that I will pay their comission once agreement is done.This was totally against their stated policy but I had to agree to it as I had no other choice.so I deposited €500.
Secondly when I was offered to view the property ,homecompany stated its cold rent €470 & warm rent €600 in their email.However when the contract was signed ,they wrote(Home Company prepared the contract) the rent €600 altogether without mentioning cold rent & warm rent separately as no where in their terms it is mentioned that comission will be calculated on the amount which is actually mentioed in the contract I thought that its understood that comssion will be based on cold rent since everyone knew what the cold rent amount was.However they calculated it in on €500 (& not €470) stating that 500 is the cold rent & gave us the receipt.I overlooked this point as our landlord had left to Canada same day so we could not discuss these small issues though I should have .
Now at the time of contract termination I realized that cold rent is €470 & not 500 as I confirmed it from the landlord in writing.When we contacted home company they first refused to agree to it however when argued they said they will check what is the actual cold rent & will let us know.After atleast 10 reminders,they have now sent us another invoice stating that since the rent mentioned on the contract is 600 so the comission will now be calculated on 600 rather than on 500 or 470 and we owe them mony rather than they owe us.My question is since Home Company prepared the contract they should have put the cold rent & NK separately…so they tried to trick us.Secondly they backed out of their agreed comission (based on €500) and have now calculated their new comission.
Can anybody suggest what to do since it is not a matter of 70-80 euros…….it’s a matter of decieving and backing out of what was agreed & doing whatever they want.Is there any authority that can help me?
