Visa for an Indian citizen marrying a German

Advice on how the permit application system works

Hello Everyone,
My name is Simon, I have a German girlfriend and we are contemplating getting married when I would be visiting her in Mid- November , considering that most of her family will be present and already have approved of the marriage. My passport is Indian and I will be on a Schengen Visa for the trip there, my girlfriend checked with the local Immigration office in her town and they have told her that after the marriage, my visa would be extended for a period of 1-2 years to a residence permit , to be confirmed after the marriage and submission of relevant documents. I have used the " Search" function as adviced by the other knowledgeable posters and I offer my gratitude since it has helped me to confirm the list of documents I might need for the marriage.

Might I be allowed to voice a few doubts however
,
(i) Would I get a Residence permit after marriage without having to go back to India upon expiry of the Schengen Visa?
(ii) I am a Tattoo artist/Artist with 2 year's experience . What are the chances of finding work for Tattoo artists in Germany?

I hope they have not been asked earlier, and my apologies If I missed them when trawling through the threads thrown up on looking for answers to my questions. My Thanks to the posters of Toytowngermany.com.

Thank you Janx Spirit, I have the requisite documents referred to in the webpage and have already persued the web page from the link provided on an earlier post. The local Immigration office in her town (my girlfriend's) cited the following as necessary ( Valid Passport, Two passport photographs, Proof of Health Insurance, Anmeldebestätigung, Finanzierungsnachweis, Gesundheitszeugnis für Aufenthaltserlaubnis, Birth Certificate and Führungszeugnis from the Indian Consulate) for a marriage on a visitor's visa. I have read a lot of online posts and have had a varied number of answers.
Is it possible to get married on a Schengen Visa and get a Residency permit without having to go back to India? It would be greatly distressing to find out the Immigration office had made any sort of mistake. Thanking you in advance.

If you have doubts, there is no better source than the very people who you will have to deal with in order to get your residency papers. Ask them.

I was student and I got married a german national without any problem. But it all depends where you would like to marry. Marrying a german national with Indian passport in Germany is very difficult task. You need to prove and produce N number of documents. When my wife enquired and told me the list of needed docs I was supraised because the german official do not have belief on Docs from India. So finally we got married in Denmark. I asked my friends circle , they told me without valid residence permit you wont be granted or either permitted to get marry in Germany. Or you wife has to apply a special visa that allows you to get marry in Germany, again for that you have to produce lots of docs. Better check with Denmark marriage rules whether ur permitted to marry a EU national with your visit visa. Or ask your GF to comedown India to get marry you. After your marriage you will be granted 1 yr residence permit, depends upon your language proficiency it will extend every year but normally your eligible to get PR in 3 years.

Hello everone..

I am an Indian and my girlfriend is a German citizen. Recently, we have decide to get married in Denmark (accepted by german officials) as the process of marriage in Germany is very long.
But I am a student in France and she is a student in Germany. Moreover, I have Carte de sejour (Aufenthaltserlaubnis fuer Studenten in German) of France till Mid of December and the appointment which we have got in Denmark is Mid of November, so I roughly have a month after marriage in EU to stay.

Now, my queries are

1) Do I have to apply for Family reunion Visa in France or India for GERMANY to get "Aufenthaltserlaubnis" for 3 years OR as I can travel with Aufenthaltserlaubnis(of France) to Germany till mid of december, I can directly come and take "Aufenthaltserlaubnis"(of Germany) after getting married?

2) In case I need to take, I hardly have a month to apply for family reunion VISA in France, I have to return back to India and apply over there which I want to avoid because of reasons like the process is very long and takes forever, moreover I need to provide SPOUSE EMPLOYMENT CONTRACT certificate which I can't as she is still a student.

So, please help me out guys in this moment of panic and I really beg to answer especially to the people who have already been through this kind of situation.

No idea about your job chances as a tattoo artist. Can tell you following though.

First, you will need an Ehefähigkeitsbescheinigung to get married. This takes forever to get. It is basically a piece of paper stating that you aren't married to anybody else. You will need to take care of that immediately and in India. There is no way they will let you marry in Germany without that piece of paper, you gotta believe me on this. Don't know why they didn't mention this to you.

Second, you apply to get married at the Standesamt. After handing in all the papers, they get checked by the Standesbeamte. This takes a few months. So make sure your Schengen visa is valid long enough. After checking it, the Standesamt will let you know if your papers were accepted. This gets done by some Bavarian court. If they say no, it's no. You can complain all you like. Won't change a thing. If in the meantime you have done something silly and positive such as arranging your wedding and paying for all of this in advance, it won't impress them. No is no. You will have to provide the papers they need. No, being able to check something online won't impress them either. Only after the court gives their ok may you apply for a date to get married. Depending on the time of year, you will be able to quickly get an appointment at the Standesamt (a couple of weeks for instance) or, if you pick a special date, you will have to wait longer.

Your visa has to be valid for the duration of the whole procedure, but best would be to ask them (Einwohnermeldeamt) directly and to get their answer in written form.

Third, all your papers have to be issued new. Your birth certificate, your Ehefähigkeitsbescheinigung etc has to be new, the validity of these documents expires after 6 months, I kid you not. Then you have to go through the whole procedure again.

As soon as you have the piece of paper saying you married in Germany, you go to the Einwohnermeldeamt and you get the visa immediately. The visa is valid for 2-3 years. After that you get the full permanent residence permit. Two friends of mine married Chinese women and went through the procedure. It was absolutely no problem when they got all the papers together. Remember, bureaucrats need papers like normal people need oxygen.

Good luck, you are going to need it. I know of many EU citizens, i.e. without needing visas or whatever, who tried to get married in Germany and failed. This includes myself after having lived here uninterruptedly for 18 years. Didn't need a visa either. Had to get married elsewhere in the end, lost all the money I had to prepay too.
