I have been teaching English and an international Kindergaten for close to 3 months. However, they have only given me 30 min breaks daily within my scheduled 40hr work week. They dated my contract from the 1st of August (a copy is with the KVR), but only paided me in cash for half of the month. Its true that they only asked me to start working from the 13th. But dont they have to honor the contract?

In addition to this, my work permit is dated from sep 18th. So they told me my heath insurance would'nt start until the sept 18th. But I thought that as an English teacher i only need a residence permit to work. So in my calucation they owe me money for half of august and over 17hrs of compensation time aback pay for health insurance.
I'm so tired I'm begining to not care about the children!!!

Lastly, they told us (staff) that since I'm not a state certified teacher I should not be alone with the children. But I me and a girl who is only a uni intern (Prakticant) have been in soley charge of this children (Farschule and kigga group) for the past 3 months!!!

Are they within there rights??

You were probably not hired as a teacher but as an assistant of some type. As an employee in Germany you are obligated to have health insurance and they are obligated to pay part of it.

The breaks may be illegal (ok, probably are) but 40 hours a week is not 80 hours a week, so the tiredness might come from something else? (Yes, I must admit 40 hours a week with small children may feel like 80 hours a week!).

I think it's 30 minutes break per 6 hours of working time. There are threads on this (Im too tired to search myself right now).

Well actually on my permit its says Erzieherin wich i think means Kindergarten Teacher... But thank you for your heplful reply I will try to do more research in the forums.

Sounds like you've got some valid complaints there, but there's no reason you should expect to get paid for the full month of August if you only worked half of it.

AZO = Arbeitszeit Ordnung ( Laws governing working hours ) state you must have a break of at least 30 min after 4 hours.. The maximal working week is 46 hours, the maximal working day is 10 hrs. My advice is not to get up the bosses nose so soon after starting a new job, he can sack you ( by giving you notice and he does not have to give a reason ) during the probationary period = Probezeit and you cannot do anything about it. You can go to a labour tribunal court only if you have been employed for longer as 6 months. Approx 14% of your salary is deducted for sickness insurance, of which your employer must pay 50%.
