I am indian Citizen married to wife who holds German Citizenship. I arrived in germany on spouse dependent visa and residing since last 12 months in FF. Unfortunately from last couple of weeks We had been going through some critical issues with each other along with social one. And at this point we have decided to call off our marriage. Im not sure about this step but If We Do, Will there be issue to my Stay and Work in Germany?? I haven't contacted any attorney or seeked any info for such but will appriciate any input to right direction.

TT is not your local Doctor or Lawyer. The best info. given here can only be taken at face value.
It is in your intrest to get the facts for your pituclar situation from a professional who can help... Go see a Lawyer ASAP.

Now for your answer. I do believe there is a min. 5 yr limit on getting a perm visa/permit. Since you haven't been her for 5 yrs, it look like you
might be saying bye-bye to germany.

If you have stayed in germany for two years you can get a separate workpermit/residentpermit independent of your wife. Otherwise you visa will be in jeopardy.

If you know german have a look below

Does anyone know a quick and easy answer to this question?

My husband and I are getting divorced in the near future. I am American, he is German. I have lived in Germany for 6 years now and have a Niederlassungserlaubnis. As far as I can tell, since I never need to renew this, I am in the free and clear to stay here and work here in Germany. I also don't know if it matters, but we have a 6 year old son together, who has dual nationality.

I know I saw something about this on TT before, but a thorough search did not bring up the answers.

Any advice and/or links are appreciated.

Answer was provided above...

1. Your already over the 2 year limit required for permanet status
2. You already have an unlimited permit.
3. Your son is a German national, and depends on you for support.

Your in the clear.
