German language requirements for a dependent visa

Hello all,
Can anyone please help me on the below issue?.
my husband has got a job in germany and he got his visa long back. he has travelled to germany and took up a job there before 2 months. i applied for visa on july itself. its been almost 8 weeks over by now. this week i got a mail from the consulate saying that i need to submit the certification from the goethe institute . that certification is to prove that i have adequate german language. Fourtunately i was attending classes for the past 1month and i will be getting my certificate by next week. when i enquired with the consulate whether they can wait till next week so that i can submit my certificate, they said i have to again attend a test there at the chennai consulate. the visa officer will be talking to me in Deutsch and i have to answer that. If they are satisfied then they wil issue me the approval letter which takes almost 2-3days and i have to resubmit it again to get my visa. its been almost 2 months over and i am really in a depressed state as my husband is there and i am here...can anyone please tell me what will be the questions they usually ask in the consulate to test your langague proficiency?.

This is also my concern since I am also applying for a dependent visa. I filed my application at the German Embassy in Kuala Lumpur and they did not ask for any certificate of German Language proficiency( not needed there). However, my husband's visa was already approved, my visa and my son's visa are still pending and might even take 4-6 months more. By November, my husband will be going to Germany, me and my son back to the Philippines( we are Filipinos). When I inquired to the German Embassy in Manila if I need to take the German Language Exam ( since this is required in Manila and technically, my visa might not be available by the time I go back to the Philippines), the Consul informed me that although this is required, there are EXCEPTIONS! She sent me the leaflet. Apparently, this is not posted on the German Embassy Manila website.

You just have to check if you qualify for the Exception and hopefully you do not have to take the exam.

These are the exceptions based on the familiennachzug flyer

Are there exceptions?

Yes. You do not have to prove any knowledge of German if one of the following statements applies:

You or your spouse are citizens of a member state of the European Union (excluding Germany).
You are incapable of demonstrating basic knowledge of the German language due to a physical or mental illness
or handicap.
You have a university degree or corresponding qualification, or exceptionally in your case, there is a recognisably
lesser integration requirement for other reasons.
You do not wish to reside permanently in Germany

Your spouse has a residence permit as
highly-skilled worker (§ 19 AufenthG).
researcher (§ 20 AufenthG).
company founder (§ 21 AufenthG).
person entitled to asylum (§ 25 (1) or § 26 (3) AufenthG).
recognised refugee (§ 25 (2) or § 26 (3) AufenthG).
holder of a permanent right of residence from other EU
countries (§ 38 a AufenthG).

Your spouse is a citizen of Australia, Israel, Japan, Canada, the Republic of Korea, New Zealand or the United States
of America.

thanks yeah!!!. still i come under one of the exceptions... from india they do want a certification...but i dont understand why there will be one more test when i am producing my certificate from the institute which they have mentioned..?.i have the pdf file with me. thanks once again

I applied for my dependent visa on 2nd July 2007 from Kolkata German consulate. I read about the language requirement and I have enrolled for a super intensive course in the Goethe Institut here. They have not sent me any letter about this requirement as of now.. but decided to enroll myself anyway (didnt want to waste time - it's taking long enough already!).

Do you have any idea whether they expect fluent communication or basic communication is fine? Also, do they look at our language capabilities before or after the marriage verification is complete?

as i have travelled to germany last year only after my marraige they dint verify much about my marraige till now. but i heard from one of my friend that they will ask the agents to verify it in the register office.not sure whether they do it or not. still i am in touch with my local reg. office ppl. they said no verification came as of now.
regarding the language certification, this vfs office ppl told me not to do as they will not ask becoz i have applied on july and the law is passed only on august 2007.
suddenly this month i got the mail like that from the consulate. we have to prove it with A1 certification. they are expecting little fluentcy it seems. its not enough if u take this certification alone, but you have to take up a test with the consulate also. so many things are on the pipeline..im really frustated by the way the ppl are working in chennai. horrible experience yah...

I can relate with what you are experiencing right now. Yes, it is very frustrating. Have you asked the Embassy if you have to pay a fee so that your records (marriage certificate) can be verified? Because at the German Embassy in Manila, one has to pay 200 Euros for records to be further examined. However, there should be a request first from the German Authorities abroad that they would like to further examine the documents. Even if you are willing to pay, and there is no "official" request, meaning, the request is not on their system, they will not accept payment and they will not examine the documents.

I think ( but I am not sure) that this is the usual process, particularly to countries where the Legalization of Documents by the German Embassy has been suspended. ( Philippines is one of those countries)

Yes, marriage verification it seems is made compulsory if it is the first time you are traveling to Germany with a dependent visa. I went with a tourist visa before and stayed for 3 months. They do not consider that at all. They charge some $150 for the verification. And your husband has to give a written letter stating that his spouse will bear the costs of the verification, and all that...

The system is...

Your application file goes to the Foreigner's office in Germany---> They verify the docs, meet the husband and see his papers----> They then send a letter asking for a marriage verification (if the applicant has not been issued a dependent visa before) ----> The consulate charges the applicant for the investigation ---> The investigation report is sent to the foreigner's office again in Germany ----> If they are satisfied, they send an approval letter for the visa to be issued

Anyway, this language skills issue is a major one... sad.gif
