The DVLA, which holds drivers' details, said: "If a driver says he was out of the country he has to prove he was not driving."

So the DVLA accepts that you can be out of the country but still driving in the country?

Most driving penalties are CIVIL penalties, not criminal. There's no "innocent until proven guilty" benchmark for such cases.

@BadDoggie: I was caught speeding on the motorway in England and it was taken to court although I didn't have to turn up if I was pleading "guilty", in England we have a different judicial system that in the States.
