When must you move out of an apartment?

The last day of the month or the morning after?

I'm currently living in a two-person shared apartment (Wohngemeinschaft). The renter who also lives here said that if I want to move out, I have to notify him 1 month prior. I have done that. I told him last month that I want to move out in June. (Last week, he told me that he doesn't want to live here anymore either - he wants to rent out the entire apartment.)

This week, he has been a bit annoying about my housing situation. He hasn't spoken to me about anything apart from that. Today, the only things he said were, "So when are you moving out?" I said, "Tomorrow." He said, "In the morning?" I said, "Yes." Also, I remember asking him a couple of days ago, "When do I have to move out by?" He said, "The 1st of June."

I have kept all the receipts I got him to make every month. He wrote the receipts in this format, "Paid rent for the month of May."

So, I'm wondering, am I in the right to sleep here tonight, the 31st of May and then move out tomorrow morning? I mean, that's the way it works at hotels... you pay for the number of nights you stay, and then they tell you the time you have to leave by the next morning or you'll pay for another day.

Another question I have is: Do I have to ask him to give me my deposit back, or is he just supposed to give it back without my asking?

I think typically the person should be able to move in on the first. That usually involves you not being there and the apartment being ship shape. However if it simply means you get out of bed at seven and take the your overnight kit and leave there shouldn't really be a problem should there? However I might not be german enough.

Yes, you're in the right, although as Iain says it's all a bit late now anyway. Generally, you would arrange with the person moving into your room when you need to be out of there - usually at some point during the morning on the 1st. WGs tend to be more flexible than when renting an entire apartment, and the fact that you haven't signed a contract means that you can basically do what you want anyway.

I would move out but first get about five euros in 1 cent coins. Then move out and leave all the one cent coins (all 500) spread out on the floor. Just my 2 cents.
