Is anyone aware whether or not is is legal to hold back the rent on your apartment in lieu of the damage deposit? We are leaving our apartment at the end of May and we anticipate we may have issues with the return of our damage deposit. Thanks.
This has been discussed before, I think it was precisely in a thread on deposits, try to look it up. AFAIK the practice is illegal but I'm afraid I don't have any references or anything.

It is definitely NOT legal. I held back 2 months when we moved last November and the ex-landlord sued me for it. He can hold the deposit for 6 months before you are able to try and retrieve what you can but you cannot combine the two issues...

It depends on the contract you signed.. Have a read thru yours and see if this was written into it.
My last 2 had a clause that disallowed this type of action. If yours has such a clause and you do it anyway, be prepaired
for any legal action thrown your way.
