Employer sponsored visas for the U.S.

Taking the visa even if you turn down the job

Question: My boyfriend is from Munich and I am in Los Angeles. He is working on getting a sponsor and visa to come here for as long as possible. If he gets a visa this way and decides that he doesn't want to keep the job, can he still stay for the amount of time allowed on the visa or would he have to go back to Germany?

Not a chance in hell of staying. Think about it - an employer spends a lot of money on getting the visa for your boyfriend and then he leaves... Hmmmm... Think about it...

If you want a better way then just go for the Adjustment of Status, the Authorisation of Employment and you need to file a petition. Will all take at least 6 months and you will go through hell during that time. But at least he will be able to stay there

I think most US companies provide work visas, which are non-transferable (i.e., they're only valid for that company). It's a lot more hassle for them to get green cards, and there's the drawback that the employee can easily leave, so there's not really much incentive for them to do it.

If your boyfriend hates his job he could probably go for interviews and try to find another company that's willing to organise a new work visa for him. Or you could marry him.
