I'm a Malaysian and my fiance are a German who currently presiding in Germany... we're planning to get married on May... what we have in questions are as a Malaysian I don't need to have a visa to enter Germany and if we are getting married within the 90 days of entering Germany, will I have to return to my country to apply for spousal visa or I can get a spousal visa without needing to get back to my country? All answers will be much appreciated...

Ask your embassy.
People might be able to give you general non-EU information, but only your embassy can give you the specifics for your case.

Hello, hopefully someone has an answer for me. I've looked around but have found nothing specific.
I am an American with a German fiance. I have been in Germany almost 90 days now visiting him. We are getting married in 2 weeks in the Bahamas and then will be returning here. At that point, i will probably have 3 days in the 90 day period left, but with a different status- married. All the websites say to apply for a residency (spousal?) visa once in Germany.
So my question is- will they allow me back in without a Visa, since the 90-day tourist stay will be almost over? Will the marriage certificate be enough evidence to let me in (and stay in) so that we can then apply for the spousal visa?
Help please!

Recalling the events from an earlier thread you should make sure that your marriage in the Bahamas is recognised in Germany...

Well, as you get married in the Bahamas, you exit Germany and reenter Germany after your marriage. Then you will get a new tourist visa. That means another 90 days. During these 90 days your then hubby should get the marriage registered and after that you can apply for a residency permit. The permit should be granted to you for at least a period of one year without further ado.

Joe F- thanks for your post. i was wondering if they would issue me a new tourist visa, since (i thought) the 90day tourist visa is within a 6 month period...so since i will be returning only 2 weeks later, would it still be granted? or would they send me back to the US for 3 months and then i'd be allowed back in?!
(and yes, i checked before- the bahams wedding is as valid as one in the US.)

as far as I was aware you are right about the 6 monthes before you get a new tourist visa. Maybe you could apply for an extention on your tourist visa before you leave if you explain your situation?

Due to lot of paper work in Germany, it is difficult for many to get married in Germany on their 90 days visa, as Standesamt needs more then 3 months to get the papers varified, so most of the people are looking for other possibilities. The best way for doing so is to travel to Sweden, apply for marriage there, they need somewhere between 2 to 3 weeks for giving the permission for marriage and after getting the approval of marriage, the marriage could be done in one day in the city court. For getting married in Sweden, you need to prove your identity (A passport with valid Visa) or if you do not require visa for entering in Schengen, then the Passport it self, your birth certificate, A no marriage certificate (from your home country) and Marriage Liscence or Marriage law from your home country, The same will be required for your german partner.
You need to bring all these documents to any Tax office in Sweden (Skatteverket) and will apply for Certificate of No Impediment (Hindersprövning), the tax office need about two to three weeks for issuance of this Hindersprövning, and once you get it, you can get married in the City Court, after the marriage you will get a certificate of marriage and you need to bring it back to Tax office, they will keep this paper and will issue you a Marriage certificate, After getting the Marriage certificate get it attested from a Notar (appostile).(on the different internet website about marriage in sweden, the information are outdated) but i am having a fresh experience as one of my friend married last month in sweden and now he is having a german visa.
When back in Germany, get this marriage certificate translated into german language, and go to auslander behorde, tell them that you are now married to a german national, normaly they take about one week for issuing you the Visa based on your marriage to the German national, and meanwhile you should get your meldung with your German partner in the Rathaus.
Thats the most easiest way for solving this problem...

and I forgot to write that all of your documents should be attested from Foreign office of your home country or the embassy of your country in sweden.

hey i wrote about a month ago. just to let ya know how it went, i had no problem getting back into germany. i flew via amsterdam and so they stamped my passport and waved me thru, no q's asked. when i got into munich i didn't have to go thru customs or whatever because i was already in the EU (i guess).
so hopefully anyone else in a similar situation will have as easy of a time!! now just gotta get the spousal visa done...
and getting married in the bahamas is a great way to go! i highly recommend it:)

You might run in to problems when you go to get your new visa. As being that you have been in the Schengen countries for over 90 days. You are only allowed to be in those countries for 90 days in a 6 month period. Leaving Germany then coming back does not count unless you were out of the country for 3 months. I wish you luck and hope they don't question it.

I am a Malaysian who is married to a Polish citizen residing in Munich. The officials at the German Embassy in Malaysia have advised us to submit all documentations and wait until the dependent visa has been issued in Kuala Lumpur before i leave for Germany. Even if you enter Germany before being issued the visa, you will still have to return to Malaysia to obtain the dependent visa. The whole process takes between 6 - 8 weeks.
The Malaysian German Embassy website provides useful information and i think that would be the best place for you to start.
