Thief clones credit card and makes purchases

Is card holder innocent until proven guilty?

So which way round is it ?

Background:

1. My credit card gets cloned
2. €1,450 gets booked to my account for items I did not purchase
3. Credit company contact me to check for card misuse
4. I confirm that I did not buy these items and offered proof
5. Transactions cancelled and money returned to my account
6. Some months later get a letter from a lawyer acting on behalf of one of the affected companies saying we owe €150 for legal bills and the original payment
7. Reply to lawyers to inform them that the misuse (fraud) was reported to the credit card company and my money returned.
8. Get a letter from the laywers yesterday to say the case is still open and where is the cash.
9. We call back and say hey, we explained that it was not me and the credit card company have refunded cash.
10. They say they dont care and it is up to us to prove our innocence and not for them to prove we owe the cash.

So, where do we stand? Can I just tell them to bugger of? Many thanks for any insights.

The Kanzlei - Auer Witte Thiel appears to be pretty well known for some underhanded business practices. I Googled them and there are hundreds of links.

Anything you have in writing - correspondence, debit statement, credit statement etc., send to Auer cc the Rechtsanwaltskammer. Include any correspondence with Auer in the letter to the RAK.

surely your credit card insurance should cover this? Should they not be directing their enquiries directly to the bank if fraud has been accepted by your credit card and not to you?

The lawyers office said quite openly they would do nothing to check the story and we have to do everything, including going to the Police. Great way to spend the weekend !!

Do not send letter to Auer, do not pay €150, go directly to RAK. You have provided Auer with all the info he needs, what else should you prove? You might even want to contact the company he claims to be representing. Did he send a power of attorney along with the letter or just inform you he is representing them? The weather this weekend is going to be crap anyway. Stay in, write to the RAK, play games with your girls to cheer yourself up.
