C.O.D. - cash on delivery

Hello,

I placed an order by email on Monday, they said next day delivery. On Tuesday I send three emails to try and get confirmation of delivery and called once. There response on the phone was that they would send me an email. I never received the order or email yesterday. So last night I sent and email canceling the order.

This morning I get and email asking the question, that I never received the order? This can take 1 to 2 days!

It’s a COD so can I legally refuse the order if they try and deliver it today?

You can cancel any order that has no written contract (e.g. internet, email or telephone) within 14 days without having to give any reason. The vendor must collect the returned goods (which must be unopened) at their cost. Either refuse the delivery ("Zustellung verweigert") or accept it, and simply contact them to collect it.
