tried searching but couldnt find anything specificlly for this so:
yesterday when the flash thunderstorm kicked in we had the windows open in our top floor flat raced home early just in time to get home for the end of the storm and at the same time get soaked by the rain.
and now under one of our skylights theres a huge soaked rain water stain right in the centre of the room
tried soaking up what i could but its now left a huge yellow stain (coming from the underlay underneath i presume) and is giving off a really nasty smell thats filling the whole room (so much so you can barely stay in the room without the windows open)
so now my questions are - is water damage generally covered on the landlords insurance or will i be accountable for replacing the carpet if needs be (as we are moving back to england at the end of august we wil need to replace then before we leave) - what is the general consenus in germany - in UK it would come under the landlords responsiblity but i dont know here
im also considering renting a steam cleaner to see if that might save the job but not sure how effective this would be vs the carpet with the underlay rotting and giving off the smell (cant see any other reason why the smell is so bad)
any help on this matter would be greatly appreciated

Do you have insurance and if so, which kind?
You see, if you have Hausratsversicherung (contents insurance), the open window can be considered to be grob fahrlässig (negligent) and you won't be covered plus the carpet may not be considered your property.
Your Haftpflicht (liability insurance) may pay as Haftpflicht generally covers negligency but may not cover the carpet if it isn't considered to be your property, so do pay, some don't.
So really you need to find out the amount of damage and get an estimate of costs then approach your insurer.
You might consider contacting your Mietverein or the Verbraucherzentale for more info.
The water damage (expoloding boiler) that I had last year was covered by my landlord's insurance as I had no active role in the water's entry method. An open window is a different matter though.

er i dunno its a rented apartment and was still in england when housemate signed the flat contract before i moved out here will check that over though
i assume it will be the standard insurance that comes with renting a flat

Not sure how it works in Germany but in UK the landlord would only be responsible if it was a problem with the building. I imagine leaving the windows open in the rain would make it your responsibility to repair / need to claim off your own insurance.

You'd also have to check the rental agreement to see if the carpet is an explicit part of the agreement.
It was also be different if the storm had opened the windows instead of the windows being left open (were you negligent or not?).

And try and lift the carpet to air it or think of borrowing a wet/dry cleaner to get the damp out. You could try

Water damage such as this is unlikely to be covered by the Landlords insurance as you could be considered negligent in leaving the windows open, so it's your fault and not his. It *might* be covered by your own Hausratversicherung (contents inusrance) if you have it, but will almost certainly be covered by Liability Insurance (Haftpflichtversicherung) as the damaged property is not yours (I presume).
