Basically what the topic says..I have come to a roadblock in getting my Auf?arb erlaubnis, and I am aware that marriage can save me from going back...but how, where, and cheapest? Please help...I posted a thread on here re: Desperate Father...I just need to know the answer to this question asap...lol...please help.
Showem
Well, you need a German who's willing to marry you first. Then go to another country, probably the U.S. would be quickest and easiest, and get hitched. Get the paperwork stamped by an Apostille, officially translated and then take it to the authorities.
Johnny English
Do you have a victim already lined up?
roots
Do you have a girlfriend/fiancee?

If no, then the quickest way to get married is to quickly finding a girl first
Keydeck
When I was in Austria there was a going rate of about €5000-€8000 paid by girls from Romania to marry Austrian blokes. Perhaps you could offer that to some of our TT ladies and they might help you out.

Might be helpful to have the background here:

I am a very desperate father in need of help. To make a long story short. I was stationed here from 90-93, married a German national in 91, after my tour in 93...received my Aufherlbns/Arbeitserlbnis and worked here from July 93-July 94, moved back with my wife and 2 kids to the US. In 96 filed for divorce, wife fled the country with kids, came here and hid. By the time my idiots attorneys found out about the Hague Convention, it was too late to get my kids back. In 2000, came here to finish this custody dispute once and for all. Anyways..after 5 more yrs, I have moved here to Germany. I had finished school in the US as a chef, and came here to do my externship. I received my Aufnis till Sept 30, 2005, I am now currently finished with my externship, and have applied at a Hotel here in the city I live in. Received my work contract , from my future emploer to be, but have been denied my Arbeits..nis, due to the unemployment of German Nationals. I am at a lost now on what I can do, do I have any rights here, while my children are German citizens? My ex and I are on good grounds, but her hands are tied to(she has no idea either what to do, but understands I need to be here for my kids). I am getting the run around now at the KV, and Arbtsamt, what can I do? I have a little over 2 weeks left on my res. permit. Is ther anything(laws) that pertain to my situation, that I can enforce or show these 2 amts, to get what I need to stay here? Thank you. I will give my address here, if you would like to send me something personal. jwbbaz@hotmail.com
Johnny English
For €8,000 Euros I will marry you.
ajohnson
Easiest way is to marry in the States...may not be the cheapest unless you can find some cheap flights someplace. But the paperwork is easy peasy. Just show a couple of passports, sign a paper, say I do and done. You are married. Some states are easier than others. Las Vegas is of course known for easy, quick marriages. But lots of other states have civil ceremony options or small "drive through" chapels to get married at...TN for example. Not sure about anywhere around here as it seems to be a bitch to marry in Germany (at least if it involves a previous divorce or non-Germans).
jml
Any chance of your ex or anyone else you know marrying you (in the fashion outlined by Showem and ajohnson) for the sake of the kids? Or are you looking for a german "wife" as well?
DDBug
Do you have any sort of custody arrangement ? Then you "need" to be here to raise the kids (until they are 16). At least so I was told when my son was a baby.
jml
In the meantime, you should check out your options for living in Austria til you get this sorted. May not be ideal but its a hell of a lot closer than the US.
Johnny English
Bear in mind they get dead suspicious if you wanna use a marriage as a reason to stay.

When I came 18 months ago they would only register me on the basis of "income" or "marriage". I chose the marriage route 'cos I have been married to my German wife for 6 years, together for 12 etc, two kids that both have German passports.

They still faffed about and only gave me a 3 year passport stamp 'cos they said too many foreigners try and get in using marriage as an excuse!!!

It was all a joke 'cos I am a UK citizen so they have to let me in anyway. Just being difficult sods basically.

I can imagine if you had 2 weeks on your existing permission, and used a 7 day old marriage as a reason to stay they will be VERY tricky with you.
quarblotz
have your employer, the hotel, give 'em hell at the KVR. go to the KVR and explain that it's a hotel so you need to be multilingual, it's high-class so they need someone with this-and-such qualification. don't let it rest.

failing that, i thought it was easy to get hitched in the netherlands...? living in austria is also a good idea.
Nicky
Am amazed at the reaction to this idea of marriage in order to stay. Doesn't marriage have any meaning whatsoever these days?
Keydeck
I agree with you Nicky, but then people will do what they have to do when they feel the circumstances require it. I'm sure marriage means something to him but he seems to be putting the priority on being near his kids. I can understand that and whilst I don't condone marriages of convenience, I can see why he would be heading in that direction. Being able to be with his kids on a regular basis is far more important. He's not just looking into the possibilities because he likes the beer.
Showem
Nicky, it's not up to me to decide what marriage means to him.

oh what a bugger. i dounbt theyd believe you got married for anything else except for your AE. try the austria thing there are more jobs on offer thee with a bigger tourist industry and they may be happier to employ you instead of a german! you may have to put the marrying thing more onto a mid trm plan. but get your employers to nag the bastards to death, only they can help you in the next two weeks.
Ulysses
Can't your employer help you? Surely, all he has to do is provide you with a letter stating that he specifically needs you as there is no-one in Germany who can provide the skills that you do.

Exactly! When I got my work permit etc., I showed them a contract that says I earn X amount of money per month. My permit was issued immediately, no waiting, because I was considered to be 'highly skilled' based on the amount of money I was making and therefore they would not find anyone in the allotted amount of time with my skill set to fill my job.

So, get your employer to help you. Have them give you a contract that shows that you are making more money and you will fall into that 'highly skilled' category.

Don't get married just to stay in the country. Not worth it!
Tbunny
I married a German man here in Germany 2 years ago, only took three weeks.
We got married thought the Standesamt (think that is spelt correctly).
only costed 200 euro and the rest is up to you.
Keydeck
Are you still married to him and did you just do it for the right to stay?
Tbunny
still married, we always wanted to get married, but basically we did it so soon just so I could stay.
Keydeck
Fair enough. Wish you all the best.
Tbunny
thanks Keydeck.
Kza
Ah so is it actually legally wrong to get married just to enable to someone to stay here, and who has the burdon of proof? I just assumed they simply wouldnt be able to judge what reasons might be behind a marriage. Would they in fact be suspicious just because the date of the marriage happened to just before someone wanted to apply for a residence permit? Heh or do they have marriage inspectors like in the movies or something that come around and watch you shag or something?

Where do I apply for that job?
Keydeck
In Austria they do have inspectors who pop around to say hi every once in a while in cases of suspicious marriages. Suspicious being pretty much any Austrian bloke marrying a girl from the likes of Romania. They also have sneaky underhand methods of phoning you up seperately to ask questions that you should both know the answers to if living together.
tom_a
For those of you speaking German, the following link documents the process of "checking" on suspicious marriages followed by the Ausländerbehörde of the city of Hamburg:

Johnny English
In the UK they also interview the two parties seperately like a quiz show. So I guess they ask her loads of questions like:

When is his birthday?

What is his favourite food?

What sports does he like?

I'm sure we can all think of more suitable questions they can ask the guy. I'm just taking a 5 minute break from being rude.

I thought it took 6 weeks in Berlin? Have they changed it or am I misinformed. Or is it different depending where abouts in Germany you live? Anyone know?
tom_a
I think there are no fixed rules anymore. It used to be the case that they publicly posted the "proposed marriages" at the relevant city hall for a few weeks before the intended wedding date, which delayed the process (it was called "Aufgebot bestellen", don't ask me what that means). But they discontinued doing so a few years ago.

I believe if your kids are german citizens you can receive Arbeitsgenehmigung and Aufenthaltserlaubnis without getting married. Anyways, that was the case with me. I went to the KVR with my girlfriend (german citizen and mother of my two children) and I recieved all necessary documents within 45 minutes. Absolutley no questions or hassles. Just had to pay them some Euros and wait for the authorities to put the permit and stamp in my passport. She was rather shocked how painless it was and under the same impression that we must first get married. Not that it mattered...I couldn't find any work decent work sad.gif
knusper_muesli
I think getting a quickee marriage now would look pretty damn suspicious, considering his background, especially that he has just been turned down for an aufenthaltserlaubnis and that his existing one is about to run out.

They may not be as extreme about foreign marriages in Germany as in the UK, but they still don't allow everything to go through, especially when it looks that suspicious.

That being said, I've heard that there is little to no austausch between the KVR in different areas - so if you do decide to do it, go to another city!

Thats strange. I'm also a UK citizen and I've been in and out of Germany, Switzerland and France (from Switzerland, Germany, Canada, France) several times and my passport has never been stamped.

Errr, I don't know what you told them, but according to EU law and current legislation in Germany, you'll always get a renewable 5-year res permit when you first register here. My other half got here 18 months ago and we just went to the KVR, filled in a few forms and showed his contract and confirmation letter by his employer. They never asked any questions or were awkward, just got on with their job and a short time later we could up his Aufenthaltsgenehmigung and Steuerkarte. But maybe this was a one-off phase of brilliance... wink.gif

TBH questions like that could backfire even with a couple that have been together a long time, if I was to be asked (for example) what my husbands favourite food was, I'd probably give a different answer than he would, even though I know him really well, but his fave food also depends on his mood, somedays it would be Pellkartoffeln mit Quark Leinöl another it'd be a big juicy steak with Bratkartoffeln and Sauce Bernaise...

We did a test like that for a laugh and failed quite badly, as did the two other couples we did the test with.
