Hello, I have posted the same ad about 2 weeks ago - The flat is available again as the person who was supposed to take the flat didn't sign the contact at the end-
The apartment is empty now (we just moved). It's a 72sm, 2,5 room with a big living room and a large bedroom with Balcony south facing.
Kitchen semi furnished - the rent is about 910 Warm.
It's 5 min Walk from the U5 Prinzregentenplatz and 10 min from Max weber platz, 2 bus stops from Ostbahnof.
Supermarkets and shops, Fitness center, PrinzregenteBad swiminig pool around the area,

There might be a way to avoid the provision. If applications are solid (good salary and long stay) then the landlord accepts direct applications without agent.
Provision should not be a big barrier I believe-
The rent is cheap for this area, and in 1 year you get back your money
sometimes you get a flat without provision .. but you have to buy a kitchen! And it's a lot of money as well

What money one gets back? and from whom? The rent or the provision fee or what are you talking about here?

i think the OP means that the difference between the actual rent and what he/she believes to be the market rate over 12 months is equivalent to the provision paid to the agent.

The actual rent would be the same irrespective of agent or no agent. Further, there won't be any hike(s) in monthly rent in 12 months, if you rent it for longer than 12 months.

This is correct -
Here is the difference;
Let's look at 2 "similar" flats: same area, same square mtrs and both nice condition
Landlord A will put his price: 1000 E / no provision
Landlord B will put his price: 800 E / 2 months provision
After a year with Landlord B, you make a saving of 200 x 12 = 2400. So it covers the provision
If you decide to stay 1 - 2 - 3 more years, then you will pay 2400 - 4800 - 7000 the landlord A.
Bottom line is: Landlord can be much more crook than agent :-) This is what to watch out!

if i remember correctly, though, feda, if the landlord employs an agent to rent out the flat, the agent has a right to charge provision even if the landlord subsequently finds a tenant themselves. So your assertion that the provision could be avoided is possibly not true.

I have checked with the landlord - I can send direct application. But they must be very solid.
I have talked to the agent as well to let him know that I will also start posting ads-
I just have to admit that the agent has good relationship with the landlord, so I applications are limit he can give a good push. That's why I am not completely disconnecting the agent here...

For your comparison to be correct fede, you would have to first show some evidence as to why this particular flat is 20% below the going market rate. I don't believe that to be the case.
May I ask why you are so concerned about a new tenant for this flat if you have already left?
Are you actually seeking someone to take over the remainder of your lease?

OG: If a tenant finds a landlord through an agent and, then, proceeds to sign a contract with the landlord, then the tenant will be charged a provision by the agent. If the landlord finds himself another tenant without the help of the agent, the agent has no right to charge the another tenant, as the another tenant had no business with the agent.
Feda, obviously, your calculation is under the assumption that two apartments have different rents and fails when the rents are same.

That's a nice looking place..but good luck finding someone who will fork out money to an agent for doing..well next to nothing. I really do loathe this Mackler/Provision system here...is it like this in other countries?? It sure as hell isn't in countries that I've lived in...the agents should make their cut from the landlord here, not the tenant!

Bluedave- this is correct. We moved faster than forecasted as I needed a bigger flat because of family extention :-)
We have found a perfect flat but we had to take it from this month. This is was a very short notice.
But I can also confirm that the flat is really nice :-)
