Pregnancy coverage for temp agency employees - Germany

Is it different than being employed by a company

verliebt
Hello,

The company I work for contracts all their full time employees through a temp agency. So, we are full time, but our "employer" is the temp agency, not the company we work for.

Does anyone know if the coverage, time off, etc... is the same when working for a temp agency on a full contract (signed 2 year contract with this company through the temp agency). Is there anything to look out for? I assume you wont have a guarantee of a job after the maternity leave, but do you still get all the other full benefits?

Obviously, I dont want to go asking at the temp agency, as need to make sure all basis are covered before venturing into all of this

Thanks
JeffZ
The relevant fact is that you're on a term contract, regardless of whether it's with the temp agency or the actual employer. I found this at eltern.de:

Rough translation: A limited employment contract is not extended as a result of pregnancy or parental leave, but instead expires at the agreed point in time. Dismissal protection does not apply to this period, for you are not actually dismissed; your contract merely expires. The employer is not required to give you the job back after parental leave. However, the employer cannot end the work relationship with the pregnant employee prematurely, either - employment of the mom-to-be must continue to the end of the contract term.

Thanks for the response.

I am not really worried (or care that much at all) about if I have a job to go back to I am more concerned about the benefits and what is covered and monthly muttersgeld etc.. that you are entitled to. I just dont know if for some reason, since you are not a "real" employee in the eyes of most (as are temp) - or does it not matter at all as long as you are under a full time contract????
