No reply to my cancellation request - DB RMV fines

Entered to wrong class wagon

Hi,

In Frankfurt Airport, my wife and I were rushing to catch the train and we got on the train via the nearest gate at the last moment. When we jumped in to the train with our luggage, we realized that it was a first class wagon. We had a monthly ticket for second class, therefore we wanted to move to the second class area, but there were a lot of luggage in front of the door between wagons. They were blocking the way.
So, we waited in front of the regular exit gates to go out in the next stop and get on the the second class wagon. There were empty seats in the first class wagon, but we did not sit on them and waited in front of the gates by standing on our feet with our luggage.

Then, two DB officials who saw all these facts, asked for our tickets. We showed our second class monthly ticket and told them that we were going to switch the wagon in the next stop, and the reason we didn't change it immediately was the fact that there were a lot of luggage blocking the door between wagons. However, they still fined us and told us that we have to write the situation to info@sc-fahrpreisnacherhebung.de to demand cancellation of the fines.

Well, I wrote the situation (in English, my German is too weak) to the mail address above and requested the cancellation of the fines.

It has been 11 days and there is no reply yet. How long should I wait for the answer? And, do they have to answer a mail written in English?

I think I have to pay the fine in 14 days. Is this correct? If I pay the fine, does this affect my cancellation request?

Have you got a copy of the letter and did you send it via registered post? Have you got a copy of the receipt? If you have all these things then I probably wouldn't worry.

Of course it is much better if the letter had been in German, but you can't change that now. It might be why they are taking so long to respond. I couldn't say.

As long as you have copies of the facts I wouldn't pay the fine. You can prove that you contested it if you have. Do you have legal insurance just in case?

11 days is nothing. Give it another month or two and then restart this thread.

I have an electronic copy of the e-mail I sent in my Yahoo account. In addition, when I sent them an e-mail, there was an automatic reply. So I know that they received my e-mail.

I don't have legal insurance. On the ticket they gave me, they say:

Nach den geltenden Tarifbestimmungen sind Sie verpflichtet, innerhalb von 14 tagen den erhöhten Fahrpreis zu zahlen. Ansonsten kommen weitere Kosten auf Size zu.
I am worried about this sentence. If I pay the fine, would this mean that I accept the penalty?

Nope. What it says is this.

According to the currently valid fare regulations you are bound to pay the increased fare price, within 14 days. Otherwise further costs will be due (literally are coming to you).

(Not sure what Kosten auf Size zu means)

40 Euro for me + 40 Euro for my wife = 80 Euro
