Subsidary - German GMBH or English LLC?

Antipodean country to start a Berlin office.

benn
Hi all, my company is seeking to start a Berlin-based office in 6-12 months time. We already have 3 Germans working for us (remotely and in New Zealand) and German accounts for 70% of our sales, so we'd like to set up shop closer to our customers. What is the best way to structure this? Set up a German mini-GMBH or an company registered in England?

Most of our employees have German visas, but one or two will be Kiwis - does there have to be a German employer sponsoring them?

Could someone point me at a good visa / business specialist who could answer some of these questions for me?

If you are opening an office in Berlin you will have to deal with german business and tax laws. Why make the situation even more complicated by having to deal with english laws in addition?

Hi benn,

I am from India, living in Germany for more than 6 years and I have my friend|s manufacturing unit in India and i want to start the subsidiary of it here in Frankfurt. I heard that starting a subsidiary of a parent company, the parent company have to invest a capital of 250,000 euros and employment to 5 , if you cannot invest so much then your project have to be submitted to the Federal commerce chamber and they have to approve it based on if it really boost the German economy etc. For german gmbh, you need to have a liability of 25, 0000 euros with multiple partners. for more info you can approach IHK or german business portal. please share with me if you get to know more about it.thanks
