Need an English-speaking divorce lawyer - Hamburg

Advice and recommendations sought

amyjoy
Hello,

I am originally from England and I separated from my husband (also british) 18 months ago.I live in Hamburg with our 3 year old daughter and have a "mini job" giving me 400 euros a month. My (ex) husband lives in Munich at the moment and sends me some money when he can.I would really like to get a divorce but I can't afford it and have no idea if we can actually get a divorce here ,or we need to apply in Britain. It would be great if anyone has any advice and knows of an english speaking lawyer who I can talk to.
Any help would be great!

Thanks

If you and your husband are both UK citizens (as indicated in your post) and live in Germany on a permanent basis you have to go through the German court system when filing for divorce. You can however choose between applying UK law or German law.

Get in touch with the Jugendamt. They will then make your husband pay for the child at least. He will not get around this.

Hi Amyjoy,

Please retain an attorney immediately. If your income is only 400 per month, you can get legal aide and/or possibly have your ex pay for the legal costs. If your ex is gainfully employed, you are entitled to receive spouse support plus since it appears you already have physical custody, he must also pay child support. This must be legalized. Once you have retained counsel, ask him or her to file for an emergency petition for physical custody and alimony support for yourself. Don't know how long you and the x have been living in Germany or where your child was born.

If your ex is not employed at this time, you can still have an order entered so that should he find employment in the future, he'd be responsible for back pay as well. Don't the let the ex get away with not paying monthly and consistently for your child.
