Neglecting to register a change of address

My wife is spanish and I am third-country national.I got my family resident card (on the basis of self-sufficent funds )in November 2007 .When we left the first address in frankfurt in April this year,we didn't know we need to anmelden our address and since then we have been staying in our friend's house for 5 months.Now our friend just came back to Germany from USA and told us we had to abmelden old address and anmeldung the new address. Does anybody have experince about that? Can we abmelden old address and anmelden the new address now?Will the immigration department cancel our rights of residence as an EU national and the spouse of an EU national? Can we apply again if they cancel our right of residence?

It's a requirement to keep the authority that you registered your residency with up to date with any change in address.

My opinion is that you should just go to them and tell them you've moved - otherwise you'll be going against the regulations for the rest of your time here. You didn't know or forgot. Hardly the first.

I've been late in registering a change of address before (although not as long as five months and I'm an EU citizen though not sure that's relevant). I just gave my new address, and to the "since when?" question, I said I was sorry for it being a bit late, rather than evading my error. No problem. It just slid past.

Yeah change the address now. Just don't mention that you already moved 5 months ago. Just put a date that was in the previous week on the form where it says moving date.

Indeed. Small point of order though - having done it recently. My update was done by the official on their PC. So I gave the info verbally. No form to fill myself.

Speech can be a bit harder to blag than writing but, again, just go for it wink.gif.

Chances are it'll be no problem but take something that proves your address (and possibly that you are still financially independent just in case it goes down the "are you living off your friends" line). I find attack is the best form of defence in this sort of situ (as with the saying sorry bit if needed) smile.gif.

Now I want to know if they will cancel our right of residence because of our not abmeldung and anmeldung. Can we re-apply the right of residence?

They will not cancel it, in the worse case scenario you will be scolded and get a fine. Your wife is from the EU, you are safe.
