File a complaint with eBay. They go through a process where the seller has to reply. If he doesn't you can claim the money back from your credit card company (or PayPal if you used them).
And PlaneGirl, always check out the sellers history. Most times bad things show up here.

pay pal will only deal with the complaint and refund if you inform them within 30 days. after that the credit card co should refund it.

Only time I ever had problems with another eBayer, the stuff arrived 2 days after I registered my complaint. You have to get tough with these people !

Where did you purchase the item from? Don't be so hasty in assuming that this person is in the wrong. There have been issues between the US and Germany due to a contract end with the company that the US deals with in Germany (GLS). Many packages from there have been taking up to 10 weeks to arrive.
If it was from somewhere else, like the UK, there are still issues with items getting stuck in customs. If you've already waited past the 30 day deadline, then at least wait a bit more and see what the shipping date is when the item finally arrives.
Another thing to consider (especially if you purchased it on ebay.de) is, did you pay for insurance for the shipping? If not, it may be unfair for you to cancel the payment through your credit card. Of course, you can, but you may not be in the right there. Things DO get lost in the mail.
Most sellers with over 98% positive are legit, unless you have some other reason to believe that perhaps their account was hijacked...

Go to the international trading board on Ebay UK or US. There are several Germans on those boards who will be able to advise you competently on this. Sorry, I can't provide a link since I'm on a handheld at the moment (laptop go kaput).

You can report it to the police. I agree the International Trading board is the best place to start. Go to ebay uk, click Community, then Discussion boards, then International Trading Help. If you title your thread something like 'problem with seller in Austria' one of the freindly Germans there will help you file a police report.

Ok, now I'm at a real computer.
Ebay UK International Trading BoardEbay US International Trading BoardJust go to one of them. The Germans who are on one board usually also frequent the other, so you probably wouldn't get any more replies posting on both.
Good luck!

thanks for the idea about the police report...I have written up a letter that I will send him threatening legal action. Also got a post up at the international trade ebay discussion group. This stuff frustrates me to no end.

@Rizzo
Yes, Or just send'em a
p-p-p-powerbook@koorosh
In which case you contact the seller, and tell'em something, like Sorry, I bidded on the wrong auction, but got yours by mistake, etc. etc. I'm sure you can come up with something. No they can't send the cops to your house. What are you thinking!!! It's frig'n Ebay...
