Legal recourse when apartment has no internet

Hello

I have a business that is done exclusively online so naturally the very first thing i ask when i am wishing to rent an apartment is if WLAN or WIFI or whatever depending on the country is available and easy to get and reliable as obviously without internet i cannot work and have no way of making any money. For me i would rent a tent over the Taj Mahal if the Taj Mahal did not have internet and the tent did.

So in mid January i would a nice apartment that i liked very much and of course i asked the woman who was showing me this apartment if it had internet and she said yes and i should be able to get it in within a week EASY. Well i never got her to sign any document stating this as i never really have ever had a problem when someone said there was internet there was internet.

This woman was the tenant not the landlord and about a week later she phoned me and told me that the landlord would like to meet with me and wished to rent to me and i was so happy. The landord does not speak English but the tenant did speak perfect English and i had a German friend with me and he acted as translator and everything was fine and i signed the contract and on the first of Feb i moved into this apartment.

My German friend called the internet company the WLAN one and they were coming out to give me internet within a couple or so days. They came out and informed me that there had never been internet in this apartment and for whatever reason it was impossible for me to get internet with them. They suggested i try a cable internet company so my friend made an apointment with them. Now it has been almost two weeks and the cable company comes out and i figure everything is fine now but after working for over two hours the tech said he needed to get into another room which was locked on the top floor and that the "cable box" was there and so my friend called the landlord and he gave me the phone number of the man who rents that room and i called and called for three days but no answer i knocked on his door no answer finally called back the landlord who informed me that this man was on "holidays" till the following Tuesday. Ok so now i

t is 3 weeks and i finally contact this man and he is not very happy that he must take off 3 hours from work to be there for the cable company to do whatever they have to do to connect my apt with this cable box in his apt.

So finally he agrees and the cable company comes out and i am so happy as i figure now i finally have internet. NO way as there were other "technical difficulites" forgive me i have no idea what they were but now i am told that some sub company of this cable company must come out again and do some other work with cable lines and god only knows what so ok they come out and inform me that whatever they did was not enough but just one more "adjustment" and for sure i will have my internet in two days. Ok so yesterday this tech came out and i was once again so sure finally everything was ok but i was informed that whatever cable "plan" whatever that means and what i have in this apartment are "incompatible" and the truth is this apartment can NEVER have internet other than with an ISB stick which is what i have bewen using but impossible to work with just an isb stick prohibitively expensive.

Now what I would like to know is if i have any legal recourse i can take as now i must move out of this apartment and everyone knows how difficult is is to find an apt in Munich and i swear i NEVER would have taken this or any apartment without WLAN but there is nothing in my contract saying this as i believed the woman as why not.

I have now without exaggeration lost close to $10000 in business and i am sure i have lost potential clients. This has been a nightmare for me. Not only cant i work i have really nothing to do as internet is my life and when not working i watch films surf the net enjoy you tube things i cannot do with only an ISB stick so i have had nothing but 4 walls for company for the past5 weeks with no light at the end of the tunnel.

Anything i can do about this situation? Btw there are three or four other apartments in this building and they all do have WLAN my apt is "special" as it is a basement apt and was never intended to be an apt which i guess is why it is not set up as all. the other apts are and i did ask the other tenants if they would be willing to share their WLAN with me and all said sure but sadly they are too far away and i cant pick up any of their signals.

Please help i need to work and having such limited internet access is driving me crazy.

Since internet was never guaranteed in the lease you have no legal recourse.

It does seem strange that a USB stick would be so expensive. I would get more information! Since you have native German speakers you can ask to help - bring one with you.

By the way using other people´s internet is only a short term solution because the person paying the bill would be responsible for everything downloaded on that account and sometimes people are known to download/access forbidden pages (notably child pornography). Therefore unless they are very trusting/know you very well they will regretfully tell you sooner or later they cannot do it anymore!

Welcome to Germany - if it is not in writing it did not happen!!

I need more than 5 GB a month for my business. If it were only a matter of 25 euros a month i would not have started this thread.

I had never used a usb stick before never even heard of them before coming here. My friend has been loading 5 GBs every couple of days or i might as well have no internet as it is so slow it takes hours now anyway to upload and download files that ordinarily do so in a matter of a few minutes. Cannot i hold this woman responsible for lying to me as my friend heard her too say that WLAN was a cinch?

Are there any good internet cafes in munich and i mean good because out of desperation i went to the one at the Haufbahnhof upstairs and they said i needed a GErman cell phone which i have and the guy there was very nice and tried his best to get me online but he was unsuccessful. So then i went to Starbucks and i could easily log onto the internet the trouble was that there are so few tables and all full and i know this is always the case as i have been to Starbucks there before not for internet just for coffee and always crowded and the only possibility is to stand and this is ridiculous to stand ten or more hours a day trying to conduct business from a crowded coffee shop.

Also what seems to take up a grat deal of megabytes is the VOIP phone i rely on to talk with clients all over the world it takes of so many imporrible to talk with clients.

Any internet cafes that are not too crowded preferably with pw rather than need for German cell phone/

I can rent you a tent with wifi for $5000. You can put it over the Taj Mahal if you like.

Can you invest in an iPhone and set it up as your own personal hotspot? I know that works in a lot of places, for a lot of people. Whether it works in Munich, though, I can't say. Might be worth investigating!

Just wondering how did you lose so much money when there are libraries or internet cafes in Munich where you could have gotten internet access?

If it was never intended to be an apartment, is it being rented legally? Meaning, is it up to code, etc. I have no idea what the laws are about that but maybe that is your recourse.

In future, you can contact providers directly to verify availability before renting a place. Or just make sure they can show you a working internet connection when you view it.

Any McDonalds. Any Starbucks. Any cafe you check out and find yourself. Use earplugs. Rent a space in a shared office. Rent a tiny, tiny place with internet.

Don't expect to use someone else's cable!

What is the data volume you require? Vodafone and T-Mobile offer HSPA USB dongles with volume limits up to 10-20GB. Monthly charges are not cheap, starts at 40 EUR /month. After your monthly 10GB usage, you are not cutoff, but speed is throttled.

are any of them beaming 802.11n at 5ghz rather than at 2.4ghz (or both)? if not, then this could be your answer.

I have vodafone umts with the usb stick. I pay something like 25 bucks for "flat rate", which is actually 5 gigs at a fairly decent speed and anything over that at a snail's pace. I, too, need over 5 gigs per month, but generally less than 10 gigs. Once you are nearing the 5 gig mark, they send you an sms, offering another 5 gigs for 19.99.

So I actually wind up paying 45 bucks a month for my connection, but it works for my situation, which is basically that I don't want any contracts specific to the apartment I'm currently in. When I move, I take the stick with me. No contract to cancel, no automatic contract extensions, and no hassle getting a new connection in my new apartment.

Edit: and I just noticed that I should now upgrade to a package that they didn't offer back then. It has 10 gigs and is faster for the same 45 bucks I'm currently paying.

it took you 5 weeks to take action?

there are plenty of free wifi spots; but the best is to get a USB 3G service (or, tether an iPhone) and then you should be set. if you have lost $10,000 due to your own incompetence well - enough said. you made it here to Toytown; so, looks like you have internet access now. suck it up and move on, you should have done something earlier.

I don't think he was suckered in.

i asked the woman who was showing me this apartment if it had internet and she said yes and i should be able to get it in within a week EASY.

The woman he asked, probably assumed that he'd be able to get it hooked up just as easily as all of the other tenants had. The fact that she said he'd have to get it hooked up shows that the apartment wasn't hooked up and she meant that, as far as she knew, it could be hooked up easily. She's assumedly not an IT expert, specialising in internet connections, so she had no reason to believe otherwise.
